Hundreds of students ordered Dr Dre Beats Headphones from the Barnes and Nobles University Bookstore only to find out that these headphones will not be shipped to any “unqualified buyers”. According to B&N, qualified buyers must purchase a Macbook in order to receive a free pair of Beats headphones. This was not mentioned to customers upon purchase, nor after order confirmation. Buyers have also not received any reimbursement or email from the company for their mistake. Under the Uniform Commercial Code, an “Order Confirmation” is a binding contract, which requires the company to send out all the Beats ordered, regardless of the mistake on their end.
As a company, this promotion should have been clarified under what must be purchased in order to receive free beats as well as not allow the purchase to go through when no Macbooks have been added. Confirmation emails showed that the subtotal only consisted of the shipping and handling costs of $7.50, not the actual Beats which total to about $299-325. This understandably was a technical glitch, however, Barnes and Nobles should be taken the initiative to offer a worthy reimbursement to all customers. Had they clarified the offer soon enough, they would have avoided the masses of angry customers.
