Top Ten Nonviolent Marijuana Offenders Deserving Clemency
These 10 old nonviolent marijuana offenders have all been incarcerated for over 18 years. Nine of the ten are serving sentences of Life without Parole and the tenth is an 80 year old inmate who has served 30 years of a 39 year sentence.
Sentences of this magnitude for a nonviolent marijuana offense are egregious and are not fiscally responsible nor do they serve justice.
These nonviolent men have wives, children, brothers, sisters and friends who long to have them home to share a meal, a sunset, a joke. It would be so wonderful to to be able to have a meal with them that does not come from a prison vending machine.
Until a commutation is granted, they will not be able to visit with friends and family without the presence of guards, video cameras and preparatory searches. Many indignities face families when they visit loved ones.
The common thread is that none of these inmates were sentenced with a plea. Nine of them exercised their Sixth Amendment right to trial and the tenth was sentenced without trial after rejecting his plea agreement. If you do not accept a plea agreement your will receive a sentence enhancement.
