Disciplinary action against violent lawyers
This petition had 2,360 supporters
It is reported that a group of 40 lawyers beat up, shoved and forcefully removed persons from a bail hearing at a court in Patiala House District Court this afternoon. The case pertained to Kumar Kanhaiya who has been arrested under sedition law for a speech made at a meeting at JNU campus. This violent action of the lawyers constitutes a clear violation of the Code of Ethics and Rules of Professional Conduct for lawyers who are obligated to:
1. Follow the highest stand of ethics.
2. To uphold the dignity of the profession.
3. To maintain, towards the courts, a respectful attitude, bearing in mind the dignity of the judicial office.
4. To treat the opposing Advocate and all witnesses and officers of the Court with dignity and respect.
Under Section 35 of the Advocates Act, 1961, the Delhi Bar Council must refer the issue to disciplinary committee if it has any reason to believe that a lawyer on its roll has been guilty of professional or other misconduct. Hence, we urge the Chairman of the Delhi Bar Council to take immediate suo motto action and institute proceedings against these lawyers.
The court room, as a formal forum for obtaining justice, must be free from all acts of hooliganism. Therefore, we call upon you to do your duty to uphold the dignity of the profession and the sanctity of the justice system that it serves.
