I am creating this petition on behalf of my good friends Thomas Z. and Ulrike (Lilly) O. who are currently facing deportation back to Germany in the coming weeks due to a very small misunderstanding in their VISA application.

Thomas and Lilly have been in Australia for 5 years and are both extremely hard working, kind and respectful residents. I first met Thomas when he hired me as a hotel receptionist. Thomas is currently the hotels Accommodation Manager, and is responsible for Reception, Housekeeping and Maintenance (he is pretty much the backbone of our property). Lilly is Thomas' fiancé and also works reception, however she was working across three departments before COVID. They are both fully committed to their jobs and delivering high standards each day. 

The issue at hand is this: after applying in September 2017 for their Regional Sponsored Migration Scheme (a sponsored working VISA, approved by the hotel owners) they were denied in February 2019 due to the fact that the English Language Test was submitted after the VISA application, not before. The English Test was submitted in July 2018, seven months before denial. It was never made aware to them at the time of applying that this had to be done before and it took Australian Immigration 17 months to inform them.

That's 17 months of working towards building their future in Australia under the assumption that the VISA was approved.

Thomas gave Australian Immigration every piece of information they required to prove his English ability. His mother is British and he spent 6 years living and going to school in English speaking countries such as the United States of America and South Africa. In January 2021 Australian Immigration again denied their VISA, in their own words stating they "reluctantly" refused the VISA even though Thomas and Lilly have comprehensively proven that they have a high level of English skill and it all came down to "bad timing"... 

Now, because of "bad timing" they will have to leave behind 5 years of their lives and all their hard work to go back to Germany. A country that is currently averaging 10,000+ COVID cases a day (12,487 cases on Feb 3rd). They will also have no home or job/s to go back to and will have to rehome their beloved rescue cat Banjo in Australia.

It truly upsets me to see the pain they are both currently facing after having a tough time in 2020 health wise. In February 2020 what started as flu like symptoms progressed quickly into Lilly ending up in Fiona Stanley Hospital in ICU. Lilly had a Staph Infection which travelled from a hole in her tooth through her body. This settled on her heart and created Liaisons there and on her brain, within a week of being in hospital she had open heart surgery at the age of 26. Lilly spent three weeks in hospital and was able to come home just before the first WA Lockdown in 2020. This also means that Lilly is immunocompromised and catching COVID could be life threatening.  

Thomas and Lilly are wonderful people who will give anyone a chance and anything a good go. They are continuously looking out for everyone and easily the best people I've ever met. They are ideal members of our community and deserve to be residents here in Australia.
