(1/3/22) Hello, I am Ricky Hefner, I have understood so much of the procedural errors in my case that I have failed to present to the proper people what has truly been done against me, and I now know it is a huge case of discrimination, by the officer involved, as well as a Walmart employee , at which Walmart is going to be held responsible for in the end of all this. I have been wondering what has been going on , of how they could get away with what they have done, and why me. Well, they are the system that enforces the law, they believe they are above the law, many recent cases provide the truth to that statement, such as George Floyd. I once was a man who sold drugs in a small town and actually enticed the law to catch me of they could. And they never did, the one time they did, they messed up so badly on the procedure that they had to give me my requests on the situation or lose the case entirely. There are rules we all mist follow in life. even those of the courts. So after that case I was arrested while with , who I believed to be friends, at Walmart. And this is not even the case I am serving time for, but a very important case because its where it all began. The officer involved is the same officer who is on the case that I am awaiting appeal for now. Anyhow, the arrest consisted of possession of heroin, possession of methamphetamine, and paraphernalia, and I was curious as to where the heroin was that caused me to be charged with it. I'll come back to this case in a moment.... Around six months later I was arrested for another case that happened at Walmart where I bought a television from Walmart, walked to the exit of the store, showed the door greeter the receipt and was allowed to leave Walmart with a purchased television. I was charged in this case for larceny from a merchant for removing a spider wire off that particular television that I purchased, and went to trial on it, showed the jury the video footage of me showing the door greeter the receipt and subpoenaed the door greeter to show up for court this past may, almost three years after being initially charged, and was denied a key witness in the case, and was sentenced to ten(10) years after being charged with the status of habitual felon for a television that I have purchased from Walmart stores. In February of 2019 just after this incident I was walking with a girlfriend at the time and we were homeless, however e department of social services told her if she found a place big enough for us that they would provide the first and last months rent to help out. As we were walking one day we noticed a for sale sign in front of a house, and keep in mind all three of these incidences were pending when I went to trial in may of this year. All from the same county, two of which were involving the same two officers, of which one is no longer involved in law enforcement. So I call the number on the sign, and the person that answers says the house had been for closed on but it was okay to go in and look around, that both doors stayed unlocked because they needed locks on them, so with the permission of the person I called on the for sale sign we walk into what seemed to be an abandoned house and looked around, for two homeless people it looked very livable, so we decided to talk to DSS about it later and left the house, before leaving I changed some rough looking boots out for a pair of shoes that were in a pipe of trash and we left out the back door, as leaving the drive way two police cars pulled up and say they just received a call stating that I had kicked in the door to this house. Long story short I had three pending cases prior to trial in may of this year. And in each case this is what is found when I receive the video body can footage for them all. In the first case of the possession of heroin I receive body can footage for both officers involved. The officer that planted evidence near where I was sitting in this vehicle, his body cam footage is corrupted, and the female officer who was involved shows this. Audio and all available. And to save revealing any names at the time I'll use female for the female officer and male for the male officer. The video is pretty lengthy and hopefully will be shared with the public soon. While in the back of the vehicle this is what transpires. the male officers seems to pull something from the back seat near where I was sitting and the conversation goes as follows: Female: "what is that?" Male:" heroin" Female: [in a whispered tone]"uh, you blew it!" Now what makes this very important is that the object is said to be an egg shaped container taped up with black electrical tape. When it was placed into evidence it was tapped up with black electrical tape, Whole point is how did the officer know what was inside? Of a tapped up egg shaped container? I am alleging he only knew because he placed it there and the corruption of his body can footage is evidence of this along with the conversation that transported between the officers. So when I was put into court I move the court to hear my cases in order of occurrence show that I may have a fair trial and show them the corrupted nature of their officer and was denied this. the court actually tried the television incident first and then dismissed the others upon a finding of guilt when every "essential element of the charge" was never once even addressed at trial, that I was forced to represent myself at, and on the record even the district attorney admitted to a conflict of the counsel at was being forced upon me. However I was still given the choice to either represent myself, or accept conflicted counsel. I told the court clearly I would like another attorney at which they again confirmed I would either represent myself or accept the conflicted counsel, and then once I said by force I will represent myself, I was then given this conflicted counsel as stand by counsel. lol ...So fair trial? Fair opportunity to present a defense when I was denied most every single motion I filed especially one for a forensic document evaluator when a defendant. especially indigent (as I am) is entitled to this , and I believe what I had requested one for was very substantial grounds. And all those motions denied are reviewable on appeal, which I'm currently going through and have had two separate attorneys appointed and they both have violated their rules of professional conduct. The officer , at trial, the male officer stated on stand that he never conducted an investigation. that he took the Walmart employees word on filing the charges. So I have been seeking justice , and still am going to be seeking justice through this all, except now the originating of the "fruit of the poisonous tree" originated in the police department with all these cases. Listen to this, in the one case that was dismissed after being found guilty of the television case, the one where I was allowed to go into a house and look around, the officers involved as they are walking through the house one officer looks back at the other one and clearly says, "Which door are we SAYING Ricky kicked in?" lol. They both were unlockable, even in the police report the officers state the doors had no locks! And why ask which one are they saying I kicked in as if it was a choice , if I kicked one in, charge me and correctly identify the one I kicked in!!!!Not to decide which one they are gonna "SAY"

I supposedly kicked in. I mean in all three of these cases, based on the states attempt, which they have succeeded, in protecting their officer, who planted evidence on me in the first case, had him collude with a Walmart employee to accuse me of stealing a television that once you see this video footage will clearly show , I was allowed to leave Walmart with the purchased television by the Walmart door greeter after she checked the receipt at the door! So Walmart is guilty of maliciously initiating an action against me that is costing me every single day my life! I am in fear of losing my life because of this, I have missed Christmas , all of last year, news years with family, my mom and dad are elderly at this time and if I lose one of them this year, I was deprived of the last Christmas and news years to have an opportunity to spend with them because of this maliciousness that nothing is getting done about! I am not an attorney, I need help and am reaching out the best way I know to reach out. By sending this to family, who is supposed to be supporting me in this and hoping they provide it to the proper authorities and people to get something done. It should be posted online in every forum, blog, or any platform that it could be posted in, especially those of civil nature that are able to handle this while this case is still in the appeal process. I'm lost for words, my life is diminishing, my family ties are being severed! I need help, please! There have been some violations of oath of office violated by some of the officials and that is a violation to The US CONSTITUTION, and to my constitutional rights I NEED a good constitutional rights attorney and for my conviction to be overturned!!
