We the people of the State of California believe that we have risen to the call in helping our state battle the spread of COVID-19. We were placed under statewide shelter-in-place orders on March 19 to help our medical workers do their jobs and save lives, an order with which we complied readily. Going from estimates of tens or hundreds of thousands dead, depending on the source, COVID-19 has resulted in around 2,000 deaths in our state as of this writing on May 3. Our hospitalization rates and ICU rates have been very stable for at least a month now, even while case numbers increase. We believe that we have "flattened the curve" at this point, as we were asked to do by our governor. Given this, we believe it is time for the governor to announce reopening dates and allow healthy people their lives back. Although we the people took the threat of COVID-19 seriously here in California, we believe that we have done enough to begin a phased reopening immediately. Citizens are on indefinite house arrest for a virus which our medical system is handling effectively. Non-COVID medical issues, domestic abuse, and unemployment are all on the rise. Peaceful protestors are being arrested at our capitol building. You said that: "If a state or local ordinance crosses the line from an appropriate exercise of authority to stop the spread of COVID-19 into an overbearing infringement of constitutional and statutory protections, the Department of Justice may have an obligation to address that overreach in federal court." We believe that the state's current lack of transparency, arrests of peaceful protestors, and prevention of healthy people from feeding their families despite no hospital overflow indeed crosses the line from an appropriate exercise of authority to stop the spread of COVID-19 into an overbearing infringement of constitutional and statutory protections. We desire a peaceful solution, and request that you fulfill your obligation and address this overreach in federal court.
