Now that Joe Biden has been elected president and there is still a possibility that the Democrats will control the Senate everyone’s attention is turning to the Supreme Court and whether or not it should be expanded.

Some argue that expanding the court is the only way to rectify the abuse of power exercised by the Republicans in denying a hearing to Merrick Garland prior to the 2016 presidential election. Others argue that such an expansion would further politicize the Court and create a Constitutional crisis.

This ‘crisis’ could be averted by one single courageous act. Justice Neil Gorsuch, being a Constitutional scholar and having sworn to protect and defend the Constitution at each step of his judicial advancement could acknowledge that his appointment to the Supreme Court was improper and voluntarily step down effective January 21st, 2021. This would allow a Democratic president to nominate a Supreme Court justice that a Democratic president was denied in 2016.

Justice Gorsuch would return to the Federal Bench at the next available opening and he would be eligible to be re-appointed to the Supreme Court in the future should the opportunity arise. His place in history would become the justice whose heroism helped heal the nation rather than the justice who was appointed improperly and the balance of the Roberts Supreme Court would be restored. 

“We respectfully request that Supreme Court Justice Neil Gorsuch, being a Constitutional scholar and having sworn to protect and defend the Constitution at each step of his judicial advancement acknowledge that his appointment to the Supreme Court was improper and voluntarily step down from the Supreme Court effective January 21st, 2021.”
