The terms of the impending sale of Johnson Utilities to Epcor includes a 63 Million Dollar premium that more likely than not would cause rate payers in the future to pay that premium through an increase in rates or as an additional tax or fee.  The ratepayers have paid millions of dollars over the years to cover the operating costs of Johnson Utilities as well as cover expenses for improvements that were never made.  The expenses for capitol improvements of water and waste water facilities were never invested appropriately.  We have already paid a premium to Johnson Utilities and do not feel the ACC should approve this premium since EPCOR has the opportunity to capture a return on investment through an approved rate case.

Additionally, the lawsuits currently filed against Johnson Utilities are based on the mis-management of Johnson Utilities and failure to follow State guidelines.  Those lawsuits should not be dismissed as they have nothing to do with the impending sale.

We are looking to the ACC to take the rate payer's best interest into consideration before making any decision on approving the transfer of the CC&N to Epcor.  We have been ignored and our needs discounted for to long.  It is time for the ACC to use their power to right the wrongs.
