I, Rajendra M.Bongale age 65 years, a cardiac patient with no source of income wish to bring to kind notice of all following things and seek you support.
I joined The Sangli Bank Ltd., as clerk in 1975, a leading private sector bank at that time. The bank was member of Indian Banks' Association. The pay scales and service conditions were at Industry level settlement till its Amalgamation with ICICI Bank in April 2007.The amalgamation took place as per MOU signed between The Sangli bank Ltd and ICICI Bank ltd after getting due approval of RBI.
An industry level pension settlement was executed on 29/10/1993, the Sangli Bank was signatory and hence party to the settlement. As per the terms and conditions of the Pension agreement, and in accordance with the circular issued by the (then) Sangli bank ltd. I had opted for pension. Sangli Bank ltd, was suppose to create, in accordance with the provisions in the Pension scheme. But it never created a Pension fund nor it had any intention of doing so till its Amalgamation with the ICICI Bank ltd.,in April 2007.
Actually RBI, who had given permission for this Amalgamation, should have looked after for perfect implementation of MOU signed between both the banks. But now unfortunately PBI is avoiding its responsibility.
Sangli bank ltd., never had implemented Pension scheme nor allowed voluntary retirement to its employees till its Amalgamation with ICICI Bank ltd. Nor it had any exit policy for the Pension optee. If at all the employees, those who are pension optee, wanted to leave the bank, the bank use to advise them to resign. Even many employees asked for voluntary retirement but their request were not considered. I submitted my resignation after serving in the bank for 27 years.
After Amalgamation, The ICICI Bank created Pension fund in Sept 2007 for the employees of The Sangli Bank who had opted for pension in accordance with the circulars issued by the (then) Sangli bank ltd in 1994 and 2000 and started paying Pension to some of the employees. .of the Sangli bank ltd.in 2011/12, the ICICI Bank awarded pension along with arrears of pension amount with effect from 2011.
As I was also one the employees who had opted for Pension and had resigned after completion of 27 years of active service, (before submitting my resignation, I had made inquiry with the Personnel Dept of Sangli bank ltd about Pension if I opt for voluntary retirement.. I was told that my request for voluntary retirement will not be considered as bank has not any such schemes introduced).I also requested the bank to grant me pension and arrears of pension amount .For this the ICICI Bank bluntly refused my claim on the grounds that I had resigned from the Bank.I broght to the notice of ICICI Bank that since I had completed minimum requirement period to be eligible for pension and since I had opted for Pension, I should get pension, but he Bank never gave any reply to my letter.In private their authorities agree that yes, we must get pension and there as many as more than 50 eligiable ex-emplyees are there to whom the bank is laible to pay pension.
Therefore, in November 2015, I had filed the criminal case against ICICI Bank, its CEO and other Directors in Hon’ble JMFC Court-III and the Hob’ble court found substance in my case and directed the Police authorities to file a F.I.R. against Bank, against CEO and all the directors and start investigation. Accordingly a FIR was registered by the Police Authorities.
Now the Bank started playing its Dirty game and started bring all types of pressures on the Police Authorities as to not to carry out the investigation and and file a B-report(False report) with the court Authorities. When I came to know all this, then I had approached CM Karnataka, national Human rights commission, DIG (Police) Karnataka and requested support through CHANGE.ORG, I WAS SUCCESFUL IN NOT GETTING FILED B-REPORT BY POLICE AUTHORITIES. And Hence at the last moment the ICIC Bank approached HIGH COURT OF KARNATAKA and got stay order for Hon’ble HIGH Court.
I had brough all this to TV-9 (Kannada) and even they had taken my interview in this regard and about to telecast it but here also the Bank played its dirty game once again and my interview was held up without assigning any reasons to me.
So every where the Bank is using its M-power to suppress our legitimate demands and,therefore, it is getting now very difficult for us to continue our struggle as we are weak not only financially but also by age. Many of us have crossed 70 years of their life, many of us are heart patients have undergone cardiac surgery.
BUT I HAVE NOT LOST MY WILL FOR STRUGGLE.COME WHAT MAY ,LET BANK ADOPT ANY TACTICS,I AM ARE READY TO FIGHT TILL I ACHIEVE GOAL.
In 2013 one of Smt Usha Shirguppe, submitted her case to Zee Helpline. After that bank had sanctioned her pension from Nov. 2013 . But she had not received arrears of pension. In March 2015 , she had filed criminal complaint against bank ans its directors. Her claim was settled within a month.
At present I am 65 YEARS old, had undergone By-pass surgery and ICICI Bank finds itself proud by denying me my legitimate Pension and trying to show its strength against me.But I am not going to surrender so easily.
AND THEREFORE I REQUEST ALL INDIVIDUALS TO SUPPORT MY CASUE AND LET US FORCE THE ICICI BANK, A MULTINATIONAL BANK,TO LISTEN TO US AND MAKE IT TO HONOR MY DEMANDS AND THAT OF MANY MORE PEOPLE LIME ME.
I WILL TAKE UP THIS WITH OUR HON’BLE PRIME MINISTER, AND OTHER RELATED PERSONS AND IF NECESSARY I DO NOT MIND SITTING ON FAST TILL DEATH.INSTAEASD OF LIVING IN HUMILIATION BY NOT GETTING PENSION WHICH, IS MY LEGITIMATE RIGHT,IT IS BETTER TO DIE.
