Governor Cuomo and Members of the NYS Legislature:
A Petition in Support of the Establishment of a New York State Commission on Prosecutorial Misconduct and the reconciliation and passage of NYS Senate Bill S2412C and NYS Assembly Bill A5285B.
Whereas, the surge in public awareness of wrongful prosecutions and convictions resulting from prosecutorial misconduct has created a growing and pressing societal concern; and
Whereas, the disproportionate incarceration of minorities is one of the American criminal justice system’s most established problems; and
Whereas, implicit racial attitudes and stereotypes skew prosecutorial decisions in a range of racially biased ways; and
Whereas, the New York State Commission on Judicial Conduct exists to investigate claims of judicial misconduct but no such similar commission yet exists to investigate and hold accountable prosecutors in New York State; therefore be it
We the undersigned call on the New York State Legislature to create a State Commission on Prosecutorial Misconduct and encourage reconciliation of New York State Senate Bill S2412C and Assembly Bill A5285B for the creation of said Commission.
