Gov. Cuomo: Appoint the Attorney General as Special Prosecutor in Troy Police Shooting!

TO ANDREW M. CUOMO, GOVERNOR OF THE STATE OF NEW YORK:
We, the family, friends, and neighbors of Dahmeek McDonald, and other concerned individuals and organizations, urge you to appoint the Attorney General of the State of New York as Special Prosecutor in the near-fatal shooting of an unarmed young Troy resident, Dahmeek McDonald, by Troy Police Officer Jarrod Iler on August 17, 2017.

TO ALL CONCERNED WITH EQUAL JUSTICE AND ACCOUNTABILITY WHEN POLICE USE LETHAL FORCE:
On August 17, 2017, Troy Police Officer Jarrod Iler shot and seriously injured a young unarmed Black resident of Troy, Dahmeek McDonald, who was alleged to have violated parole. Though wounded in the head and arm by multiple shots, Dahmeek survived.
While it is fortunate that Dahmeek did not die, he remains physically, mentally and emotionally scarred from this brazen act of police brutality. This shooting exacerbates longstanding tensions between the community and the Troy Police and has led to more distrust.
Public pressure forced Joel Abelove, District Attorney of Rensselaer County, to recuse himself from the investigation. DA Abelove was then indicted for his cover-up of a previous Troy police killing, which provides further support for the need to appoint the Attorney General's office in this case. In addition, the Schenectady County DA, who was appointed in place of the Rensselaer DA, has been publicly silent in the more than four months since his appointment, which not only shows disinterest in conducting an investigation but a level of incompetence that warrants a recusal.
In tragic cases all over the country, local District Attorneys have failed to convict cops who kill: Eric Garner, Michael Brown, Freddie Gray, and dozens more. If the officer who shot Dahmeek is not held accountable, the next shooting might be fatal – unless the Governor steps in to change the pattern of lack of accountability.
Governor Cuomo has the power to issue an executive order moving the investigation from the Schenectady DA’s office to the jurisdiction of the Attorney General. That order would help to assure the community that Dahmeek might receive an unbiased investigation.
Additionally, if the Governor issues this order, it has the potential to bring justice to those who need it most by sending a message that the State of New York holds police officers accountable for their actions just like anyone else.
