We the undersigned and on behalf of the citizens of the United States implore the Senate to postpone a vote on the America COMPETES Act (H.R. 4521) until the provision introduced by Representative Jim Himes contained in Section 60202 is reconsidered and amended. This provision strips all due process and opportunity for public comment on the activities of the Secretary of the Treasury and the Treasury Department provided by Section 5318A, Title 31 of the United States Code, leaving the powers of this office unchecked by public opinion. As members of a democracy, we the citizens of the United States demand active involvement in the actions of our Treasury Department and discussions pertaining thereto. Furthermore, Representative Himes’ provision expands the Treasury Secretary’s list of “special measures” without defining or providing any limit within the text of the law on the enforceability of this additional measure. We the undersigned believe the language contained in this provision to be unwieldy and to extend the powers of the office of Treasury Secretary to a degree that is unwarranted and unjustifiable.
