Election for Tenure 2017-2022 of Glittering Star C.H.S Ltd. Adarsh Nagar Prabhadevi, Mumbai- 400030, was held on 23rd July 2017
Total No. of Flats: 23
Non members: 3
Members Not staying in the flats: 5
Total members present at the time of election: 16
Total Members contested: 9
Members contested for ladies seats: 2 ( both SC Candidates)
Members contested for General Seats: 7 (one candidate SC but did not contest in reserved Category, thus depriving a loyal, honest candidate from general category to become office bearer.)
As per 97th Amendment, If a SC, ST or Nomadic candidate is not there those seats should be kept vacant, but what if the SC candidate contesting from general seat just to avoid a loyal person to become a office bearer. This is not at all fair. There should be some way to scrutinize and find out and not to allow a SC candidate to contest in general category at least in a small society , the election was done in D class , but is it not mandatory to scrutinize the personal files to find out authenticity of the members, whether any member is defaulter or not when the housing society election conducted inD category that is one day election procedure results also same day so the chances of manipulation.
but when the election conducted C category there will be proper 35 days programme under that each and every candidates file scrutinise by election officer.
Up to 100 members in the society 11committer members should elect.
but manybof them
purposely not filling up the category from which they belongs to and due to this the open candidates 100% looses the election.
my society is the example read above.
so my prayers from this petition is to get the justice and get the order to stick up with category .
