FRANCESCO CANESTRI'S APPEAL FOR PERMANENT RESIDENCY

FRANCESCO CANESTRI'S APPEAL FOR PERMANENT RESIDENCY
28/08/2021
SUBJECT: PETITION AGAINST IMMIGRATION DECISION TO DECLINE MY PERMANENT RESIDENCY VISA
TO: Administrative Appeal Tribunal
ADDRESS: 13/111 St George Terrace, Perth WA 6000
ATTN: TO WHOM IT MAY CONCERN
On behalf of my family & I, I am petitioning for the appeal and reconsideration of the immigration decision to decline my application for a permanent visa (subclass 186) due to insufficient English writing, a score of 5.5 instead of a 6. Due to COVID 19 lockdown, the expiry of my 457 sponsor visa and the deadline to lodge my application for a permanent residency I found myself having to lodge my application with an IELTS result with only a 5.5 in written English. I have sat for another IELTS exam as soon as the lockdown was lifted and scored a 6 in written English. Below are copies of all my IELTS results that I have done through the years.
I first move to Australia with my wife in 2007, where I was managing coffee shops in Sydney CBD, where in 2009 my son Massimo was born. In 2014 we moved to Perth, where I further my education with a Certificate III & IV in Commercial Cookery and a Diploma in Hospitality. I have been working and managing for the past 6 years the Italian restaurant La Sosta in Fremantle. In 2019 my daughter Maddalena was born at St John of God Hospital.
It has been very hard to explain to my son Massimo that we might be moving away from the country where he is born, grew up and considers his.
I am a hard-working and dedicated family man with a strong ethical and moral value. I think a mistake did occur in considering my application after I did provide further proof of my English. I still believe in the Australian system & value, and that is why I am appealing the immigration decision as it doesn’t seem neither right nor fair.
