I started a petition titled "Abolish the felony murder rule in Indiana & its discriminatory, arbitrary and unjust appliance" because my cousin Rodney Jenkins is incarcerated for felony murder in a case where he was with a friend committing robbery and the victim of the robbery killed Rodney's friend. Rodney was charged with and convicted of felony murder for the death of his friend.

My brother is doing life without parole because of felony murder. He's done over 30 years for a burglary that he committed when he was 20 years old.

My name is Rodney Jenkins and I've been incarcerated since 1997 in a case where my accomplice was killed during a robbery,and I was charged with felony murder. My case is:(Jenkins v. State, 726 N.E.2d 268) Years later in 2015 the Indiana Supreme Court reversed a felony murder conviction where 4 people were charged with the death of their accomplice during a burglary,but the court affirmed my conviction saying because there was a weapon used it made my conduct "dangerously violent and threatening"..
(Layman v. State, No. 20S04-1509-CR-548)..however,the law in Indiana states if a killing occurs during the perpetration of, or attempt to perpetrate, ANY rape, arson, robbery or burglary it's felony murder.. (Moynihan v. State, 70 Ind. 126). The Indiana Supreme Court stated in Layman that the evidence was sufficient for burglary but not sufficient for felony murder.
I'm living the bullshit of this felony murder law,so I definitely want to see it abolished! The public defender's office doesn't help the situation at all! The cases where people were charged with their accomplice's deaths are disproportionately people of color, specifically black. As I write this post I'm in need of help, legally! Its bullshit. How you going to charge someone with murder that didnt commit murder? Lets see this same applied to cops then. If you charge 1 then you charge their partner.

In no way in any government should there be a law that puts murder on someone if they did not do it. I read "the cop shoots the friend, person in car is charged with murder." First, cop should only shoot if the person shot back. If they did not, then no shots. If they can not shoot the leg or arm to slow them down, No shots to be taken. I got this from my city's police. Second, the friend should just be jailed for robbing. If they did not rob but was just in the car not knowing their friend was going to rob. They are set free. I read the scenarios on the petition. In no way shape or form should anyone be charged with murder if they did not do it intentionally. If a lady miscarriages or the baby dies in the womb because of some reason and the mom did not know that it was dangerous. Then it is not a murder. I bring up a mom to be because in some places in the US it is considered murder if the mom to be loses the baby in the womb unintentionally. So, this applies for more than just robbing and crimes. This can happen to a mom to be pregnant to her baby too.
