Due to the recent speculation of the Supreme Court overturning the legal right to an abortion in a landmark decision case, Roe v. Wade, an amendment legalizing a right to an abortion should be added as the 28th amendment. In Roe v. Wade, the Supreme Court used the 14th Amendment’s right to privacy to extend women’s rights, including abortion. However, overturning this ruling means that millions of Americans may lose their constitutional right to privacy and safe contraceptive options. As the Declaration of Independence states, it is the government’s responsibility to protect the rights of life, liberty, and the pursuit of happiness. Upholding the idea of a balance between governmental power and individual rights is essential for the government not to overstep its role in the lives of millions of American citizens. The 28th amendment of the right to abortion is essential to the American citizens to guarantee safe options for abortion and protect their 14th amendment rights.
Proponents of banning abortion laws argue the right to an abortion is unsafe and deprives the future of many unborn children. According to Britannica, some claim “women should not be able to use abortion as a form of contraception” and “abortion promotes a culture in which human life is disposable.” However, modern abortion procedures are safe, fetuses are incapable of feeling pain, and the United States constitution has declared abortion a fundamental right. The debate over whether abortion should be a legal option continues to divide the American people.
Proposed Amendment: No person shall be deprived of their right to privacy under the 14th amendment. The people of the United States shall have the right to terminate a pregnancy by surgical procedure or medicine.
