MBIE Guidance "Repairing and rebuilding houses affected by the Canterbury earthquakes', which was initially (2010-2015) portrayed and widely used by insurers as a 'legitimate insurance response', when it has later surfaced that it is not (MBIE admission in a clarification letter, 2016).
It needs to be determined if this deception by a government ministry has caused homeowners to be disadvantaged. It appears that this deception has provided one party to the insurance contract (the insurer) with a means to reduce the standard of reinstatement below that provided by the insurance contract. Distressed and vulnerable homeowners were not in a position to understand the consequences of this deception until (often) it was too late.
