ජනතා හඬ සහ ව්‍යවස්ථා බලය

“ශ්‍රී ලංකා ජනරජයේ පරමාධිපත්‍ය ඇත්තේ ජනතාව තුළ වන අතර එය ඉවත් කළ නොහැකිය. 
පරමාධිපත්‍යයට ආණ්ඩු බලතල, මූලික අයතිවාසිකම් සහ ඡන්ද බලය ඇතුළත් වේ.” - ආණ්ඩුක්‍රම ව්‍යවස්ථාවේ 3 වැනි වගන්තිය

ආණ්ඩුක්‍රම ව්‍යවස්ථාව නිර්මාණය කර ඇත්තේ රටෙහි ස්වෛරීත්වය සහ ජනතා පරමාධිපත්‍යය ආරක්ෂා කිරීම සඳහාය. එම නිසා ආරක්ෂක අංශයන්හි වගකීම වන්නේ ද ජනතාවගේ මූලික අයිතිවාසිකම් ආරක්ෂා කරමින් ජනතාවට කිසිඳු හානියක් නොකිරීමයි.

ආණ්ඩුක්‍රම ව්‍යවස්ථාවේ 3 වැනි වගන්තියේ සඳහන් පරිදි තම පරමාධිපත්‍යය නියෝජනය කිරීම සඳහා තේරී පත් වූ නියෝජිතයන් ජනතාව විසින් ලබා දී ඇති බලතල අනිසි ලෙස භාවිතා කරන්නේ නම්, ජනතාවතේ යහපැවැත්ම කඩවීම උදෙසා බලපානු ලබන එවැනි නීති විරෝධී නියෝග සහ ක්‍රියාමාර්ග අනුගමනය නොකර සිටීමට රාජ්‍ය නිලධාරීන්ට හා ආරක්ෂක අංශ වලට අයිතියක් ඇත. 

එබැවින් ජනතාව වන අප විසින් තම රටෙහි ජාතික හා මහජන ආරක්ෂාව උදෙසා වගකීමෙන් ක්‍රියා කළ යුතු ආකාරය කවරේදැයි බලධාරීන්ට මෙලෙස යෝජනා කර සිටින්නෙමු.

1. විධායකය හා ව්‍යවස්ථාදායකය විසින් ලබාදෙන නීති විරෝධී නියෝග රජයේ නිලධාරීන් විසින් ක්‍රියාත්මක කිරීමෙන් වැළකී සිටිය යුතුය.

2. ජනතාවගේ සුබසිද්ධිය උදෙසා බලපානු ලබන කරුණු සම්බන්ධයෙන් තම මතය ප්‍රකාශ කිරීමේ අයිතිය ජනතාව සතු මූලික අයිතිවාසිකමක් වන අතර එයට එරෙහි නීති විරෝධී නියෝග රාජ්‍ය නිලධාරින් සහ ආරක්ෂක අංශයන් විසින් ක්‍රියාත්මක නොකළ යුතුය.

3. ජනතාව සතු මුදල් අවභාවිතය වැළැක්වීම සඳහා සියලුම රාජ්‍ය හා අර්ධ රාජ්‍ය ආයතන විසින් සියලු ගණුදෙනුවල සහතික කරන ලද විධිමත් දෛනික ගණුදෙනු පිළිබඳ තොරතුරු අන්තර්ජාලය ඔස්සේ නිරීක්ෂණය සඳහා ජනතාවට සාධාරණ ප්‍රවේශයක් ලබා දිය යුතුය.

4. ව්‍යවස්ථාපිත නීති මගින් ජනතාව වෙත ලබාදී ඇති අයිතිවාසිකම් උල්ලංඝනය වන අවස්ථාවලදී සාමූහික ක්‍රියා මාර්ගයන් ඔස්සේ සුදුසු නීත්‍යානුකූල ක්‍රම මගින් තම අයිතිවාසිකම් උදෙසා ක්‍රියාත්මක වීමට ජනතාවට අයිතියක් තිබිය යුතුය.

5. සමස්ත රාජ්‍ය සේවය බියෙන් හා පක්ෂග්‍රාහීත්වයෙන් තොර නිර්දේශපාලනික වටපිටාවක් යටතේ විධිමත්ව ක්‍රියාත්මක කිරීම සදහා අවශ්‍ය පහසුකම් සපයාදීමට කටයුතු කළ යුතුය.

6. ඒ ඒ පාලන වකවානු තුළදී රට වෙනුවෙන් ගන්නා ලද තීන්දු හා තීරණ වල වගකීම අදාළ අංශ සහ පුද්ගලයන් විසින්ම දැරිය යුතුය.

 

PEOPLE ARE SUPREME

"...In the Republic of Sri Lanka sovereignty is in the People and is inalienable. Sovereignty includes the powers of government, fundamental rights and the franchise..." - Article 3 of the Constitution

The Constitution of a Country is designed to safeguard the sovereignty and welfare of its People.

The prime duty of the Security Forces is to ensure that these Fundamental Rights and Obligations of the People are protected and enforced. Therefore, the Security Forces cannot be directed lawfully to harm the People, merely to provide safety to a few in Authority, who were elected by the People to represent their sovereignty as enshrined in Article 3 of the Constitution.

If the elected representatives of the People, abuse their powers given by the People, then the Security Forces have the right not to follow such illegal orders that affect the well-being of the People.

Therefore, We the People Resolve that:

1. Security Forces do not follow illegal orders against the Fundamental Rights of the People to express their opinion on matters affecting the welfare of the State or its People.

2.  Government Officials do not follow illegal orders given by the President, Prime Minister and Ministers.

3. All Government Institutions provide daily accounts of the monies spent which belong to the People, to prevent abuse of the funds belonging to the People. For this purpose, Secretaries of All Ministries and Chief Executives of all Government controlled Corporations and Agencies disclose the expenditure incurred daily on the Internet, to be monitored by the People.

4. If these fundamental issues are not implemented forthwith, which are enshrined in the Constitution as in the Right to Information Act, People will have the right to enforce their rights through suitable means by the collective action of the People.

 5. We the People, believe that our Security Forces and Government Officials will act without fear or favour in discharging their fundamental duties and obligations to safeguard the welfare of the State and all its People.
