Protect H-2B Visa Holders from Trafficking and Exploitation

Through the National Human Trafficking Resource Center (NHTRC) hotline, Polaris has learned of thousands of cases of labor trafficking and labor exploitation. Many of the people involved are in the U.S. with guestworker visas, and the visa referenced most often in labor trafficking cases is the H-2B. Centro de los Derechos del Migrante, Inc. (Center for Migrant Rights) has worked directly with workers with H-2B visas to defend their rights. H-2B workers work in construction, harvest crab meat, operate fair and carnival rides, and perform other seasonal, non-agricultural jobs. However, the rules and regulations associated with this visa have been tangled up in the courts since 2009. Because of a lack of legal protection, workers often fall prey to unlawful recruitment and abuse. Right now, the Department of Labor and the Department of Homeland Security are finalizing the regulations for H-2B visas. Please urge Secretary Perez and Secretary Johnson to protect workers from labor trafficking and exploitation by jointly issuing strong regulations today.
