Petition to remove restrictions on public roads in Fairview, Mount Hampden, Zimbabwe
We as Fairview residents demand that the developer (Fairview Properties, formerly Makebreak Trading) removes restrictions that he has imposed on public roads namely the Sandton-Fairvew Road and associated road networks inside the Fairview Phase 1 Suburb. The imposed restrictions and the narrative that the developer urges residents to buy material from Developer's sister company (Ark Hardware Shop) in Fairview infringes on basic human rights namely freedom of choice and freedom of movement. As owners of the Fairview residential properties, we feel that we are being denied entry to our properties. The developer’s restrictions are making it impossible for the us to move building materials and borehole drilling equipment (since properties are not connected to municipal/council water) to our properties. There were no restrictions in our agreements of sale and as residents we do not accept this move by the developer. All residential areas under construction allow access to trucks and lorries delivering material and for the few ones with restrictions, the conditions are clearly stated in agreements of sale. The use of road closures/boom gates on public roads violate residents’ rights as indicated above. The impact of closures materially affects issues of urban mobility and functionality, and militates against the original idea of a suburb as a place where people could move around freely, engaging in business (building houses included), social activity and recreation as part of a collective. As a general comment, we are also against the developer’s tendency of meeting with a selected few residents and makes decisions which are eventually passed into law. We reject these actions with the contempt they deserve. Any decision made regarding Fairview should be inclusive and should be adopted by residents as a collective since we have full title to our properties. We call upon the developer to remove barriers on the Sandton to Fairview Public Road and remove weight restrictions on trucks accessing our properties.
