Imagine being told that your property is no longer yours and that you have thirty days to vacate the premises.  Texas Homeowner's Associations are proceeding to foreclose on hundreds of homes due to delinquent association dues and fines.  This nightmare has become a reality for thousands of Texas home owners.

Due to the decline within the housing market, Texas is one of the worst ranking states, with among the highest record for HOA foreclosures.  Texas is also one of the fastest foreclosure states with only a 180 day redemption period. 

In Texas, Associations (HOAs) are allowed to foreclose on homesteads for something as minor as a homeowner falling behind on association dues or fines that lead to rule violations.  Texas is one of several states that allow HOAs to foreclose on its members. The majority of other states follow a judicial approach, allowing HOAs to place a lien on the property for payment once the house is voluntarily sold by the owner.

In order for a Home Owners Associations to complete a foreclosure they are not required to go before a judge. They are only required to wait a minimum of twenty seven days before selling the property on the courthouse steps. this practice is for nothing other than the financial gain of the HOA's management company. This practice has been on the rise since many home owners have experienced financial difficulties during the recent economic downturn.

Tell your Texas State Legislature that this practice must be stopped and Home Owners Associations should not be allowed to foreclose on your home.

      Because I fell behind two years of assessment fees and now they are foreclosure my home, plus all I owe them is $650.00 and now they are charging me $4,426.00 this is outrageous, its a shame that they have so much power on we home owners, plus letters and restrictions in situations that are impossible to control. Now they are charging me $800.00 just for pictures taken.

      As a homeowner, I object to any HOA using their power to foreclose on the homeowner for any reason.

      Dear: Homeowership Preservation

      I am unable to pay something towards Holt & Young P.C. legal fees, So I am contact the Homeowership Preservation and Thomas Heinemann to set-up a Legal service plan. That offers me a low-cost legal attorney to give me advice and representation. With handling my; case with Holt & Young P.C.

      However, I was just hit with a "Notice to Vacate the Property" 8/13/2013.

      HUD has indicated that I do not have a FHA Loan, which means they do not have jurisdiction over my Homeowners Association Reform Case. My plan is to contact my HOA, to explain my situation and negotiate a payment plan that is fair for both parties, with the hopes of not having to deal with Holt & Young P.C. Attorneys which legal fees of $300 quickly mushroom into $10,000 as late fees and attorney's fees.

      I would appreciate the opportunity to work out a payment plan with Holt & Young P.C. where my payments are $100.00 month with no more legal fees from this point of 9/5/2012

      I am writing to inform you about my intention of repaying Deerbrook Estates Community Association on the (delinquent past dues) to avoid Eviction on my account.

      I would like to be able to reach a mutually agreeable payment plan schedule over the next 12 months regarding my most recent Eviction . " Notice to Vacate the Property "

      I would appreciate your consideration in making this payment plan effective as soon as possible. I am requesting that you accept a monthly payment of $ 100.00 made on the 15th of each month. I will begin making my regular yearly payments of $335.00 as soon as I have recovered from this financial crisis.

      I hope you will understand my situation and work with me on this repayment plan. I shall notify you by written letter of any change in my financial situation.

      Please feel free to contact me, I can be reached by mail so we can work out a way to bring this account current which would benefit both of us. At this time, I would appreciate if you could refrain from placing any negative or derogatory reports .

      Dear : Holt & Young P.C. Attorneys

      This cease and desist letter is to inform you that your persistent actions including but not limited to

      Waiting outside my house with "Notice to Vacate the Property "papers have become unbearable .you are ordered to stop such activities immediately as they are being done in violation of the law.

      Failure to comply with this law will result in my immediately filing a complaint with the Federal Trade Commission and the Texas Attorney General’s Office.

      I am asking that you work with me on a payment plan on this property. I am seriously trying to avoid having to file a bankruptcy to avoid any further damage to my credit and would appreciate you working with: Deerbrook Estates Community Association to work out a payment arrangement.

      Since my financial position is unlikely to change within the next year or so, I am asking that you work with me to avoid a full foreclosure.

      Let this letter also serve as a warning that I may utilize camera recording devices in order to document any stalking & home harassment that we may have in the future. This letter acts as your final warning to discontinue this unwanted conduct before I pursue legal actions against you for HOA Debt Collection Abuse. At this time, I am not filing civil suit against you, as I hope we can resolve this matter without legal authoritative involvement.
