AUTISTIC OZAN NEEDS A SIGNATURE FROM THE EUROPEAN COURT OF HUMAN RIGHTS AS WELL!
Nowadays Turkey is talking about the kids who have been discriminated against and even denied their right of going to school because of their special needs, through little Ozan's story.
The sensitive columnists of the media are writing about him, ten thousands of signatures have been gathered in the 'cyber world' to support him, in short the conscience of the society is confronting this discrimination. As the system is in denial of its own legislations and continues to build a wall in front of these children and these children have been coming across serious problems even while they are trying to use their legal rights, the case has been taken to ECHR.
OZAN is 5.5 years old. He is a typical child of our times, he is very fond of i phones and taking photos and videos. He has a special interest in art. He is gifted in music and loves movies. He is also different from his peers. He has been diagnosed with Atypical autism and he wants to use his 'Right of Education' which has been assured by the constitution and attend a reception class for pre-school education. In the relevant legislations of Turkey and their regulations, there are no clauses that restrict the educational rights of a child with Autism. Even though he was entitled to attend any school after obtaining an inclusive education report by The Turkish Ministry of Education, he wasn't accepted at the school his family had applied. After this incident Ozan Sanlisoy's lawyer mother and Rock Musician father have started a legal battle.
THE CASE WAS NOT EVEN ACCEPTED
This was a first for Turkey at the same time for being a precedent for all the kids who have been in the same situation with Ozan and denied their right of education by the system and because his mother and father had opened the case with his Republic of Turkey ID card number on his behalf, as his parents. Unfortunately the legal process ended with disappointment, firstly by the decision of nol-pros made by the prosecutor's office for lack of grounds, without even finding necessary to take the testimonies of the parents, then by the superior courts review of the objection against this decision through the file and refusal of the objection without stating any legal ‘grounds’ even though this was a constitutional obligation. In short, the case could not even be opened.
THE ECHR PROCESS BEGINS
Nevertheless Ozan and his family did not give up. Because according to the legal regulations of Turkey Ozan had the legal right to attend any school. An Internet campaign was started for Ozan (and for the thousands of kids under the same situation). This campaign was named ' Give a signature for Ozan' and with TV personalities and some columnists carrying this topic to the present agenda the signatures were over 15.000 in three days. The campaign became TT (trend topic) on Twitter. Sedef Erken and Ogun Sanlisoy are now aiming to carry the legal process to ECHR with the help of these signatures. The petition will also be sent to the Ministries of Health, Education, Justice, Europe, Family and Social Policies of Turkey, The Prime Ministry, The Presidency and the T.N.A. (Turkish National Assembly) Human Rights and petitions commissions. This will happen in accordance with the European Convention of Human Rights (ECHR).
The decision of ECHR will be a light of hope for ten thousands of children who have been going through the pain of being treated as ‘second class citizens’, of not been equal, and therefore denied their basic human rights and educational rights and not being able to attend the school they wish to go and being discriminated against.
No individual and citizen should be discriminated in education due to Human Rights. It’s highly important to support the right of 6 years old Ozan also for other individuals. Discrimination is like a contagious disease, it can spread from the smallest unit to the whole organism. STOP DISCRIMINATION !
