Immediate Release of the Malawi Gay Couple Steven Monjeza and Tiwonge Chimbalanga

We the undersigned respectfully call upon his Excellency the President and the Government of Malawi to immediately release Steven Monjeza and Tiwonge Chimbalanga found guilty of LOVE .

No evidence was submitted at their trial that either of these men had committed any crime , therefore their conviction is unsound and in contravention of their human rights as set out in the Constitution of Malawi (ref article 20.) and in the African of  charter Human and Peoples' Rights - Articles 2, 3 and 4:

as outlined below .

Constitution of Malawi - Article 20:

Discrimination of persons in any form is prohibited and all persons are...guaranteed equal and effective protection against discrimination on grounds of race, colour, sex, language, religion, political or other opinion, nationality, ethnic or social origin, disability, property, birth or other status.

"Or other status" means on other grounds, which includes sexual orientation. 

 

African Charter on Human and Peoples' Rights - Articles 2, 3 and 4:

Article 2
Every individual shall be entitled to the enjoyment of the rights and freedoms recognized and guaranteed in the present Charter without distinction of any kind such as race, ethnic group, color, sex, language, religion, political or any other opinion, national and social origin, fortune, birth or other status.

Article 3
1. Every individual shall be equal before the law. 2. Every individual shall be entitled to equal protection of the law.

Article 4
Human beings are inviolable. Every human being shall be entitled to respect for his life and the integrity of his person. No one may be arbitrarily deprived of this right.

 

As Your Excellency surely knows, under the Malawian constitution, all citizens are guaranteed freedom from discrimination. These men's arrests are a contradiction to the constitution. Malawi also showed her respect for human rights by pledging to uphold the African Charter on human and people's rights, so take this opportunity to perform that duty to its fullest degree.
