She has submitted a new application for compassionate release and received word on September 6, 2013 that FMC Carswell Warden Jody R. Upton has sanctioned and forwarded her papers to the Bureau of Prisons headquarters in Washington, D.C.


      With every pretext now removed, we summon Bureau of Prisons Director Charles E. Samuels, Jr. to act appropriately and expeditiously: Review Lynne Stewart’s new application, again sanctioned and forwarded by Warden Upton. Instruct the federal attorney accordingly to file the requisite motion with a Federal Bureau of Prison recommendation for Lynne Stewart's compassionate release. Judge John G.     2. UPDATE ON JULY 31 COURT HEARING CONCERNING LYNNE STEWART

      Lynne Stewart's attorneys filed an emergency motion with Judge Koetl seeking Lynne's "immediate conditional release" pending consideration of the legal issues presented in another motion which documents that the Federal Bureau of Prisons had violated separation of powers as the 1984 Congressional Statute assigns to the Court the right to modify a prison sentence in light of facts not available at the time of trial, notably those pertaining to terminal illness.

      "Lynne Stewart is dying," stated her attorneys. She does not want to die in prison or become another statistic of someone who dies while the Bureau of Prisons delays its reconsideration of another application for compassionate release that she plans to file soon.

      Judge Koeltl will hear arguments Thursday, August 8 at 2:00 pm.

      The Federal Bureau of Prisons has DENIED Lynne Stewart’s application for compassionate release. Director Charles E. Samuels, Jr. took this action despite recommendations for compassionate release from FMC Carswell Warden Jody Upton and South Central Regional Office Director J.A. Keller, as well as the vetting of Stewart’s release plans by the Federal Probation Office in New York.

      The struggle to free Lynne Stewart continues on many fronts. First and foremost, each and every one of us must increase the number of people worldwide who sign the petition.
      Lynne Stewart’s condition is deteriorating rapidly. Medical treatment to arrest the cancer that is metastasizing in her body has been halted because she is too weak to receive it. She remains in isolation, as her white blood cell count is so low that she is at risk for generalized infection.

      We shall not stand by idly while the Federal Bureau of Prisons murders Lynne Stewart. The Bureau of Prisons can and must reverse its decision.

      One month ago I made a request for compassionate release which was honored by the warden at Carswell Federal Medical Center. Today the papers are still on a desk in Washington, D.C. even though the terminal cancer that I have contracted requires expeditious action.

      Although I requested immediate action by the Bureau of Prisons, I find it necessary to again request immediate action from you, my friends, comrades and supporters to call the three numbers listed below on Thursday, May 30 and request action on my behalf.

      This could result in my being able to access medical treatment at Sloan Kettering so that I can face the rest of my life with dignity surrounded by those I love and who love me.

      Nearly one month has elapsed since Lynne Stewart was informed that the Warden had recommended Compassionate Release. Since then there has been no indication as to when the Bureau of Prisons will file the appropriate motion with Judge John Koetl.

      Every day counts for Lynne Stewart. The cancer in Lynne Stewart’s lungs is aggressive and cancer remains in her lymph nodes and bone; her white blood count dropped so low that the prison doctor found it necessary to isolate her to reduce risk of generalized infection.

      Over 17,000 people in the United States and internationally have been moved by the prospect that Lynne Stewart will either perish in prison or so shortly after release will be on the verge of death that she will be denied the comfort and joy of being with those closest to her, including her husband, many children, grandchildren, a great grandchild and lifelong friends.

      We must step up the campaign to free Lynne Stewart.

      A major milestone has been reached in the struggle for Lynne Stewart's freedom. Lynne Stewart wrote on April 26 to confirm that the Warden at FMC Carswell recommended Compassionate Release to the Federal Bureau of Prisons.

      “So Happy that the Compassionate Release was granted at Carswell and we are on the road!!!

      "Who DID It? --- The People Yes – and we certainly deserve a VICTORY and this is one for sure!!”

      With this dramatic development, the Campaign crossed a critical threshold. We directed our attention immediately to the BOP Director.

      Following two expedited communications from former Attorney General Ramsey Clark, a probation officer inspected and approved the residence designated for Lynne Stewart's recovery.

      Thus, another hurdle has been overcome, paving the way for Lynne Stewart's Compassionate Release.

      “I shall refuse all solid food,” Dick Gregory declared on April 4, the anniversary of the assassination of Martin Luther King, Jr., “until Lynne Stewart is freed and receives medical treatment in the care of her family and with physicians of her choice without which she will die.”

      Gregory, known for his social activism as much as his for comedic wit and political commentary, has taken this step to reinforce the worldwide petition in support of Stewart’s application for compassionate release.

      As Gregory so eloquently states: “The reason for the prosecution and persecution of Lynne Stewart is evident to us all.       It has been said that secrecy begets tyranny. I think it is also , often, evidence there of. Even an accused terrrorist desreves not to be held incomunicato from the public,or to have their attorney-client privacy violated. Our Bill of Rights does state that U.S. citizens have a right to due process. It does say NO PERSON shall be denied DUE PROCESS. The grandstanding, unecessary, SWAT-TEAM way Lynne was arrested demonstrated the political nature and visciousness of the Bush regime action. And the current regime seems no better. They can prove us wrong in this case by RELEASING Lynne so she can get adequate cancer treatment RSC
