Statement from the Stop Mass Incarceration Network: 

HANDS OFF NOCHE DIAZ!
DROP ALL THE CHARGES AGAINST HIM!

Noche Diaz is a young revolutionary and a member of the People's Neighborhood Patrol of Harlem. He courageously works to safeguard constitutionally guaranteed rights of citizens in neighborhoods where these rights are often abused. Today he faces charges in Manhattan and the Bronx for witnessing police brutalizing citizens. Noche refused to leave these community members to face this brutality alone. For that he faces charges that could send him to prison for several years in his Manhattan trial. Noche is a freedom fighter who has put himself on the line to defend basic human rights in many poorer communities of color throughout New York City. He now needs our help. Please stand up for him, for our communities and yourself; Join us in saying: Stop the legal persecution of Noche and drop all the charges against him.

      April 23, 2013 | Revolution Newspaper | revcom.us April 23-The Manhattan District Attorney dropped all criminal charges against Noche Diaz, a young revolutionary and a member of the New York City Revolution Club, in two separate cases that the prosecutors had combined into one.

      Manhattan District Attorney Cyrus Vance dropped all criminal charges against Noche Diaz in a victory for him and his supporters after 18 months of hearings, protests, legal motions, and petitions. Diaz plead guilty to a single violation of Disorderly Conduct in a courtroom packed with 38 supporters, and dozens of defendants with whom Noche's statement to the judge resonated:

      "October 21, 2011 and March 27, 2012 were not your average days in Harlem, where the NYPD carries out some part of it's 1,900 daily stop and frisks, 85-90% of which are of Black or Latino people, over 90% of whom are doing nothing wrong and given no legal or legitimate reason for being stopped, and routinely put up against walls and searched, have their basic rights violated, and often worse.

      Last March Jeffeth James was on his way home when he was stopped allegedly for a faulty light on his license plate during broad daylight—Noche diaz was returning from a family gathering at his Grandmothers in the Bronx and on his way to the subway when he saw Jeffeth James being pulled from his car by 5 NYPD officers. He stopped along with a crowd that had gathered, horrified by the beating that was going down. James terrified for his life was holding on to his steering wheel – the police were pulling him from his car by his dreadlocks and then beating and kicking him on the ground. Jeffeth James had 40% of his hair pulled from his head and suffered broken ribs, but thinks his life may well have been saved by the people who had gathered on the corner to observe and video taped with their cell phones. read entire article on our blog-

      Some of you out there have never been stopped and frisked, maybe you don’t know what it actually means, what it means to be a young person coming up in New York City or maybe you know some people and you’ve heard these stories. But people need to actually know what happens every day, 1,900 times or more. Maybe you’re coming home from school, maybe you’re going to school, maybe you’re going to work, or coming home. You’re minding your own business; you’re going about your day and suddenly some cop steps to you. They grab you, they throw you up against the wall, they turn out your pockets and if you speak back you risk being thrown in jail and spending the whole night locked up and facing charges and a case, maybe having to miss school, or maybe having to miss work which you can’t afford to do. And your whole life begins to be dominated by the fact that at any moment when you walk the street, some cop can step to you and mess up your whole day, your whole week and the rest of your life.

      I am completely disgusted with stories like this... harassing innocent people, causing security issues and then acting as though they are the solution to those problems. This country is trash! I pray that God has mercy on these people who let their pride distort their understanding of the real job that they are suppose to be doing.
