Orlando Fernandez Taveras, a legal permanent resident who has resided in the country since he was 16 months old, has been held in detention for 3 years 4 months, away from his wife Lisa and daughter Isabelle. Both are critically ill with a liver condition, and Lisa lost the family home after Orlando was taken away and she became the sole provider.

Despite a judge granting relief to Orlando, he is still being held in detention while an appeal is filed. Orlando’s family badly needs him at home. Please release him and allow him to fight his case from home.

Orlando came to the U.S. legally, with greencard in hand with his mother & father in 1978 at the age of 16 months old. He has remained in this country since that time, some 33 years. He is married to a U.S. Citizen and they have a beautiful 4 year old daughter, Isabelle who looks just like him.

Orlando had a very rough upbringing and his father left when he was in his teens. He hung out with the wrong crowd when he was younger. Orlando's deportation was triggered because of two 2006 misdemeanors for petit theft involving a pack of batteries and a pack of razors. Since that time, Orlando met his wife, married her, had a child, purchased 2 cars, works and job necessary to pay his bills and is an extremely reliable member of society now. He has always worked, spent time with extended family & helped his grandparents. All of his family is here in the U.S.

Orlando has been in ICE (Immigration & Cutsoms Enforcement) custody since December 2009. He has been separated from his wife, daughter & family for 3 years (Isabelle was only 17 months old when he was taken.) His wife and daughter were evicted from their home, lost many household possessions & deemed homeless for a period of time due to the loss of Orlando's income. His wife, Lisa is disabled and was finally approved for disability.

Lisa & Isabelle moved from NY where all of their family is located to PA where Orlando is detained so they can be closer to him and visit every other week so that Isabelle can remember who he is and still maintain some sort of relationship. Although visits are through thick glass and on a monitored phone line, Lisa makes sure that they maintain this visiting when financially possible.

If Orlando were to be deported, Lisa & Isabelle will certainly not get the long-term medical care they both need and will either be forced to move to a country they do not know nor speak the language or remain here in the U.S. and be without Orlando. This would be devastating to all involved. In addition, the crime rate, drug activity and lack of modern day conveniences there would bot be good. In addittion, they would be sent there with no money, no possessions and no place to live as well as having to give up their 2 Boxers, Buddy & Bella and everyone would lose.

We had a victory in court today.  The judge granted relief to Orlando (approval of inadmissability & adjustment of status).  Despite winning our case, Orlando is still being detained. The Government attorney, Jeffrey Bubier has appealed the judge's decision.  During this time, Orlando has to remain in jail which means he will spend a 3rd Thanksgiving holiday & 3rd Christmas away from his wife & daughter who have already been without him for a little over 2 years.  In addition, Orlando was not permitted to be present during his daughters liver biopsy on Nov 14th & 15th while she was hospitalized & in ICU even though the doctor has provided evidence that Orlando should be present. 

The judge has rendered his positive decision and found that not only has Orlando changed and become a productive member of society, hard working and family man but has also provided sufficient proof that there is significant financial and medical hardship to his wife & daughter.  DESPITE these finding by an Official placed in the position to make such decisions, the Government still wants to hold him captive instead of allowing him to take care of his family.  Now that they have appealed, using the same case law they used in trial and the judge already decided in our favor, he will wait yet another 3-6 months for BIA decision.

We need your help in telling the Government & Mr. Bubier that this is UNACCEPTABLE!  Please sign this petition, share it and Call those in power listed here and tell them you Oppose Orlando's continued detention and any wish him to be released immediately and also you oppose any appeal the government is considering.

A critically ill five year old U.S. citizen, Isabelle is about to lose her daddy to deportation. Her disabled mother, Lisa, is also a U.S. citizen and, like her daughter, has a serious liver condition. Despite her illness, Lisa has spent the last four years doing everything in her power to bring her husband, Orlando Fernandez Taveras, back home since he was detained in December, 2009. An Immigration judge granted Orlando relief from deportation, but our federal government appealed that judge’s finding and has continued to pursue removing Orlando from his family. Lisa struggled through years as a single, disabled parent trying to bring her husband home and finally, after four years of detention, Orlando was released, but I.C.E. has continued to work to make Lisa’s and Isabelle’s joy short lived. The extended battle to save her family has decimated Lisa’s finances and negatively impacted her and Isabelle’s already fragile health and her dedication to her marriage is no match for the U.S. government. This week, Lisa learned her last hope of keeping her husband and Isabelle’s daddy here had failed. Orlando could now be deported at any time, so your help is desperately needed. The longer the time between visits, the more the young mother and little girl suffered. They have suffered too much already, they should not have to weather yet another blow to their lives now.
If Orlando is deported, Lisa & Isabelle will certainly not get the long-term medical care they both need and will be forced to make an impossible choice. Should they leave the rest of their family and their beloved dogs behind and move to a country where they do not know the language with no money, no possessions, not even a place to live? Their only other choice is to remain here without a husband or father to help them through the hard times their illness presents. Either choice would be devastating to them. No one benefits from Orlando’s deportation, instead, two U.S. citizens will suffer even more.

      It is with a heavy heart that I have to let all of you know our 4 1/2 yr struggle has ended up in tragedy. Orlando was deported this morning to the Dominican Republic, a place he has not been to since he was 1 year old (1978). They refused to allow us to give him a travel case as most are permitted so he basically has the shirt, pants, socks & shoes that he had on the day he was detained. No cash, no clothing, no high blood pressure medication which he desperately needs and no cosmetics and sent to a place with no family or friends or place to stay. This is what our Government has done to us. We filed a Deferment of Deportation which was denied this morning and despite also filing a Credible Fear motion which tells ICE he fears going to his country, they deported him anyway. When you file a Credible Fear interview ICE is supposed to hold you in the U.S. and not move you until you are interviewed and a judge decides. Well, ICE did not follow their own procedure and deported Orlan

      Although we filed a Habeas Petition in District Court in Feb 2013 challenging my husbands prolonged detention while he awaits the decision on his case, the court is still sitting on it therefor prolonging the detention themselves. It is evident that noone cares about the families suffering and would rather pay in excess of $280K to detain my husband (a non-violent person) than allow him to be home & work to support his family and bond with his now 5 yr old daughter (she was 16 months when he was taken into custody). To say the least we are frustrated..... 6 months waiting on a habeas & 14 months waiting on the Circuit Court. Please keep supporting us.     6. Still Waiting on decision from 3rd Circuit Court

      We just wanted to let everyone know we are still waiting on the 3rd Circuit Court to render their decision. Our attorney thinks it will likely by late spring/early summer before we hear anything. We are in the process of filing a Habeas Corpus in District court to challenge the government on his detention.       It has been 3yrs & 2 months that Orlando has been detained now & the 4th Christmas & New Years away from his family. ICE has consistantly denied Orlando's release & would rather pay over $100 a day to house & feed him than allow him to be released & work to support his family. His 4yr old daughter & wife went to visit him prior to Christmas at the facility 4hrs away from their phone for a 1hr visit &Isabelle could not understand why he won't come over her house to play with her. She cried for over 1/2hr after leaving saying how much she missed him. Enough is enough. All paperwork has been filed with the 3rd Circuit since October and now we have to sit & wait for a decision. Even when that comes, which could be another 4-8 months more at best, the nightmare may not end. It could be taken to the Supreme Court or end up back in Immigration Court. We need our supporters to PLEASE call ICE, your local representatives, President Obama &others and tell them his prolonged detention is unjust

    8. Request for Release pending Case outcome DENIED

      For the 4th time in just under 3 years, The Field Director, Thomas Decker had denied our request to release Orlando pending the coutcome of his Federal appeal. Since it is likely that the appeal will take 8 months to a year or more, Orlando will pass 3 years in detention and begin his 4th. With that, Orlando will miss his 4th Holiday Season this year away from his wife & now 4yr old daughter. It would be very helpful if eveyone would call ICE & demand his release while we await the outcome of the appeal.

      Just wanted to update everyone and let you know the 3rd Circuit has denied the governments appeal of our Stay of Removal and has extended it until our case is decided in their court. This can be another 8 mos-1yr per our attorney. I need everyone's help in trying to get ICE to release him on Humanitarian Parol or bail so he can be home and help us out with our medical issues as well as financially. He has been detained 2yrs 9 months thus far.       We have filed our appeal witht he 3rd Circuit Cout in PA and our briefing is due mid August. Orlando is still detained 2yrs & 8 months now and our fate is still hanging in the balance.       Despite our efforts in court, the BIA has overturned the Immigration Judge's decision and has ordered Orlando deported yesterday in a BIA Precedent decision case. They have already begun the process of moving him for removal to the Dominican Republic. We are in process of filing a Motion to Stay so we can appeal in Circuit Court but I do not know what the outcome will be.

      Our attorney told us she had expected to hear back from the BIA regarding the appeal made by the government by the end of March. Yesterday I received an email from her telling us she hopes to hear back from the BIA hopefully by the end of May. It has already been 2yrs & 5 months. and 5 months since we won in court yet he is still detained.

      We are at day 55 since my husband won his case and he is still detained. He has missed his 3rd Thanksgiving, Christmas & New Years with us. No progress has been made at all by the Government on their appeal and Orlando remains rotting in a prison cell with no idea how much longer this can go on. PLEASE call ICE & tell them to drop the appeal & release Orlando & also call Governor Cuomo of NY asking him to grant our Pardon. We need him home.       ICE has refused to release my husband on bail or humanitarian parole and will leave my little girl without her father for her 3rd Christmas. She also began her liver treatment today and has been home ill crying all day about not feeling well. Yet, they still don't care about her health either. The attorney for the government still has not filed the transcript or his brief to the BIA and it is about 45 days since the judge said my husband can keep his green card & granted relief. So, ICE has no regard for lives or families and leave my husband in jail to rot and my daughter to suffer while they drag their feet to file their paperwork.

      We just received the paperwork regarding appeal and the Trial Attorney for the Government is using the same case law he has brought up for the past 2 years that the Judge has already decided upon and found in our favor. My husband is becoming depressed with our 3rd set of holidays approaching and knowing he will not be there with us. My daughter has also been crying asking him on the phone if he can come home to play and that she misses him so much. She asks me every day of she can go to his house to see him. Because of this appeal we now have pay the attorney more money which drained any savings we had for Christmas presents for our daughter. How is this fair? They are making not only my husband pay but they are punishing our little girl. PLEASE tell everyone you know to call & tell ICE to drop the appeal & release Orlando. Thank you!

We won in court today and the judge has approved my husband's applications to remain here int he U.S. The governments attorney's however have reserved the right to appeal and have until Dec 6 to put in a motion. During this time my husband has to remain in jail and will miss his 3rd Thanksgiving away from us. Our lawyer has suggested to get support from everyone and see if folks would be willing to call the Immigration officials and tell them that you are opposed to any appeal on my husbands case.       The Judge has set the date. November 7th at 1pm, Judge A. Arthur will decide if Orlando will be allowed to remain here in the U.S. We have to pray that the Governments attorney does not appeal if we win or we will have at least 3 months to wait for the appelate board (BIA) to decide the case. My husband has called the court & they told him to stop harrasing them and not to call but only call his lawyer. We have waited 22 1/2 months and still no decision.       There seems to be a lack of justice in this case. It sounds as if this person was here legally and I don't think stealing a pack of razors as a teen should have him deported. The punishment does not fit the crime.

      People should not be deported over such a small thing like two misdemeanors for petty theft of a pack of batteries and a pack of razors, especially when that person had committed no crimes since, and has a wife and child both of whom are citizens. Why is our government practicing zero tolerance on this? It makes no sense.

      he's always been one of my favorites..losing his dad and his mom always having to be at work to maintain all 3 kids messed him up..he's a great man, a great dad and husband..he doesnt mean to do wrong..he's always in my prayers and wish for him to continue his life with his beautiful daughter and wife. Please give him one more chance. we are all not perfect. look at them, it breaks my heart. please one more chance :/
