My daugher Michelle was crossing the street in front our house on March 17, 2013, to meet her sister when she was struck by a car, thrown 100 feet ahead, and killed instantly. She was 17 years old and about to graduate from high school. We are devastated by her loss, made even harder because we do not know what caused the driver to hit her. The police did not require a blood test, so we will never know. We hope no one else ever has to go through the pain we have been through. Approving Michelle Sous' Law in New Jersey would at least give families like ours some closure.

Another bill in the Assembly committee would require anyone behind the wheel who is involved in a fatal wreck to provide a blood sample.

New Jersey law now requires police to determine probable cause prior to issuing a blood test.

Dubbed “Michelle’s Law,” the bill would do away with the probable cause requirement following wrecks that result in death. A4464 would deem drivers to have given consent to providing a blood sample to determine if they are under the influence of drugs. The same consent rule applies to drivers suspected of drunken driving.

“By requiring this form of sobriety test, this legislation would allow law enforcement to take direct action in a vehicle accident that causes the death of someone involved,” stated Assemblyman Benjie Wimberly, D-Bergen/Passaic.

The bill is named for Michelle Sous. The 17-year-old was struck and killed by a car as she crossed the street.

A lot has changed for the Sous family in the past eight months. Right now, Michelle Sous would have been a college freshman settling into campus life in Boston. The North Haledon teen had been accepted to an 8-year medical program and awarded a scholarship to the Massachusetts College of Pharmacy and Health and Sciences, one of her top three choices.
