We the People of the State of Vermont hold forth the following truths:

The American Declaration of Independence, signed July 4th 1776, and The Constitutional Bill of Rights, Signed September 25, 1789 remains the sovereign foundation for our freedoms, liberty, and justly outlines the boundaries for all legislation.

These documents serve as a reminder that governments will be instituted amongst the people, deriving their just powers from the consent of the governed.  They ensure a guarantee to the unalienable rights of all mankind. 

As such, henceforth, any legislation proposed by the United States Federal Government that is in direct violation of the principles outlined in these documents will be viewed as tyrannous in nature, therefore unconstitutional, and invalid in the State of Vermont.

Whereas “The National Defense Authorization Act (NDAA) 2012”  (Signed into United States Federal law on December 31, 2011 by President Barack Obama) is a direct violation of the US Constitution, and a flagrant disregard for the principles of Liberty outlined by our forefathers.

Whereas The National Defense Authorization Act is an inexcusable violation of the following Constitutional Amendments:

Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Amendment V

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Amendment VI

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.

Amendment X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

We the people of Vermont declare “The National Defense Authorization Act (NDAA) 2012” as unconstitutional and unjust infringement of our rights. As such, this legislation will not be honored or upheld in the State of Vermont.  Any federally sanctioned mandates to uphold this legislation will be ignored, and the authority of the State of Vermont will detain any federal agents or officers attempting to enforce this unconstitutional legislation.

Furthermore, any legislation submitted henceforth from the Federal Government of the United States of America that is a direct violation The US Constitution will be viewed as malicious and tyrannous acts, declared unconstitutional, and will not be honored by the residents of Vermont.

Vermont residents should have access to govern themselves in respects to the liberties and freedom outlined by the US constitution, The Decleration of Independence, and The US Bill of Rights.
