After pleading guilty to a moving violation, one pays a fine and receives points on his/her drivers license. Accumulate twelve points and you lose your driving privilleges for a period of time. But, accumulate six points and you are now subject to the surcharge system and required to pay $150.00 once each year for three years. But wait! You've already paid the ticket! Of course it doesn't stop there! Your drivers insurance -- required by the state of NJ -- also skyrockets!
Who wins? The state of New Jersey and law firms practicing Traffic Law!
The state of New Jersey benefits in an obvious way. It gets the money. But Traffic Lawyers clean up! When faced with two or more points on one's license, several hundred dollars worth of penalty for the actual violation, plus the inevitable $450.00 in Surcharges, the defendant will pay a Traffic Attorney the requested fee to have the ticket modified. MODIFIED! Isn't this Racketeering?
The entire matter needs to be re-examined. But first, the NJ Motor Vehicle Violations Surcharge System needs to be halted.
Governor Christie, find another way to raise money for the State! A way that doesn't unfairly burden the lower-income individuals.
