Xoe is being physically abused by her biological father. Her mom has provided the court system with proof and witnesses including pictures of this abuse. Kenneth fernandez saw her case and denied her custody of her daughter. She filed for a restraining order and it was also denied by him. She was told to file in Xoe's home state of NM. Ca has the right to take jurisdiction of this case under the UCCJEA law for three reasons. 1. The child is being abused. 2. The riverside family law court is familiar with our case and there is no existing orders for custody and visitation in either state. 3. The child has "ties" to the state of CA. It is where her mother her brothers and Hannahs' side of the family reside. The state of NM does not see this as an emergency case and has said it is a custody issue. The child will have to return to her abuser while custody is being established. This is everyone's concern. Please do not allow this child to return to her abuser.

my daughter is being physically abused by her biological father. I have provided the court system with proof and witnesses including my daughter of this abuse. Kenneth fernandez saw my case and denied me custody of her. I filed for a restraining order and it was also denied by him. I was told to file in her home state of NM.
