Prosecute Columbia Police for Animal Cruelty

The Issue

We the people, and the citizens of the United States, and Missouri demand the arrest and prosecution of 4 police officers under the jurisdiction of the Columbia, Missouri Police Department SWAT division.  On the evening of 2/11/10, (4) officers Roger Schlude, Michael J Cavener, Thomas Quintana and Robert Fox all participated in the intentional and unnecessary killing and cruel punishment of 2 domestic companion animals/dogs. They took the life of an 8-month-old 24lb female Pit Bull that was wearing a pink sweater and maimed the family's Welsh Corgi.  Both dogs resided at the residence of 1501 Kinloch CT. Columbia Missouri 65203 in which they served a search warrant at 17:55 hours.  The deceased female Pit Bull was confined within the residence.  In their sworn narratives officer Sergeant Roger Schlude admits to shooting 3 bullets in the side and chest of the deceased dog instantly killing her. Officer Michael J Cavener admits to shooting the deceased dog one time and the dog yelped and ran.  Officer Robert Fox admits to shooting the deceased dog in her head twice with 2 bullets instantly killing her. Thomas Quintana admits to shooting the dog 1 time in which the dog yelped and ran.  2 of the officers contend they instantly killed her in 2 seperate areas of the home in their sworn narratives.  Officer Robert Fox insisted both dogs were Pit Bulls, when one was clearly a Welsh Corgi.  They were unsure as to who fired the bullet that blew off the foot of the now maimed Welsh Corgi. They contend it was a ricochet firing in the 1,000 square foot residence. A 7-year-old minor and his mother were present within the home the entire incident. All SWAT officers present were dressed in black full-body armor and combat gear with full face ski masks & gloves from head to toe protected with industrial/military grade & strength Kevlar reinforcement able to withstand enormous pressure and penetration of gunfire and stabbing, industrial combat reinforced helmets, with steel-toe industrial strength footwear.  Armed with various arsenal including non-lethal deterrants and weaponry.  The timeline of the video footage available clearly contradicts all of the sworn officer's narratives. The officers have maintained their lives were in mortal danger of both dogs while they were were in combat gear and equipped with non-lethal weaponry, they chose not to and instead chose the option of terrorizing, inflicting pain, and ultimately death upon this family's dog, and maiming the other with his foot being shot off.  4 different officers participated in this crime of animal cruelty by shooting 7 bullets into an 8-month-old 24 lb dog.

We demand the arrest and prosecution of the above offenses under Missouri law.

 578.012. 1. A person is guilty of animal abuse when a person:

(1) Intentionally or purposely kills an animal in any manner not allowed by or expressly exempted from the provisions of sections 578.005 to 578.023 and 273.030, RSMo;

(2) Purposely or intentionally causes injury or suffering to an animal.

The United States Postal service as well as utility workers encounter a vast array of aggressive K9's in a multitude of different circumstances in which they are successfully able to deterr them consistently with non-lethal methods without having to resort to lethal and deadly force. If they can do this, there is no reason this cannot be done as well by law enforcement who is afforded and outfitted in the highest quality and grade of protective combat gear, etc; which is far more substantial than what a US postal or utility worker is ever afforded.
