Mogoeng Mogoeng has passed a number of judgements that make it clear that he condones rape in marriage, does not understand the harm that rape causes and is not in support of women's rights to say no to sex.
His judgements in the Bophutatswana High Court indicate that is he is not familiar with the law around rape, nor does he support a woman’s right to say no to sexual advances. His judgements are not in line with the Constitution that he must defend and uphold in this position.
In addition, Mogoeng has made comments that make it clear that he is not in support of the rights of LGBTI people. He is a pastor in a church that believes that homosexuality is a perversion that must be cured. This again is not in line with the constitution of South Africa.
Furthermore, Mogoeng is inexperienced as a Constitutional Court judge and there are a number of more experienced judges, who have done a substantial amount more to protect the Constitution and the rights of women.
A number of civil society groups, political parties, trade union movements and international civil society groups (such as Nobel Women) have called for the retraction of this nomination.
Although the JSC voted in favour of his nomination, it does not have to end here. We can sign this to make a difference.

We want a South Africa where women's right to say no to sex is respected, protected by the Criminal Justice System, and affirmed by members of the Constitutional Court. The appointment of Mogoeng will indicate a lack of political will on the part of the Presidency and the justice system to uphold women's rights .
We want a South Africa where LGBTI people are able to live, love and access rights that promote their freedom. The appointment of Mogoeng would make clear that our government is opposed to LGBTI rights, despite Constitutional protections.
We will not stand for this.
