I went to bed and woke up in Iraq. Judge Mark Martin must be impeached for harming plaintiff Ernest Perce's First Amendment rights.

Based on egregious pro-sharia bias, Judge Martin dismissed assault charges against Talaag Elbayomy, citing sharia and noting that in countries across the muslim world, Perce would have been executed for insulting the prophet of Islam.  (Ernest Perce wore a costume mocking the prophet of Islam and was subsequently attacked by Elbayomy.) Judge Martin also remarked that the defendant was REQUIRED BY HIS FAITH to attack Perce, then proceeded to lecture Perce on Islam, advising him that the First Amendment does not allow him to "piss off other cultures." Nor would Martin  allow video evidence of the assault. He even called Perce a "doofas."

Martin has since threatened to hold the victim in contempt for exposing his kangaroo court, thus introducing the threat of imprisonment.

He is an imminent threat to our judicial system and has single-handedly invalidated the First Amendment in this circuit. I shudder to think how he would preside over a case involving a defendant brought up on terrorism charges.

Ironically, Judge Martin is an Iraq war veteran, and I wonder if he earned his law degree at the University of Bagdhad. He is heard telling Perce "I am a Muslim and this offends me."

It is the duty of this legislative body to discipline Judge Mark Martin and remind him that limiting  the First Amendment to non-offensive speech voids the First Amendment., which is specifically meant to protect controversial speech.  Please do the right thing and follow through by protecting the Constitution.

UPDATE: I wanted to thank you all once again for your support and to tell you about the DISTURBING NEWS BLACKOUT OF THIS STORY. I expect the MSN to kill it but Fox news? Has anyone noticed a softening in their terror and islam related reporting?

Without publicity Judge martin will remain on the bench, that's how important it is for the public to know about this story. Fox News reports on the Koran burning story 2-3x per hour but has only mentioned this story once.  Which is  more important--militants rioting and trampling each other in Afghanistan or a jude implementing sharia here at home?
