The Issue

Many mothers and babies are victims of medical negligence. Many babies are born with birth defects and unfortunately many babies are born stillborn because doctors did not do everything they could do for their mothers. Many mothers in states all over have tried to get justice for their babies who were born stillborn because of a doctor. Many of these cases have been denied justice. One of the main reason theses cases have been denied Justice is because of Roe Vs. Wade and its Viability scenario. A baby is considered viable at 24 weeks. However, stillborn babies are considered to not be humans and considered not to have ever been born. Which is wrong. Stillborn babies are humans and they were born into this world just like any other baby.
I am a mother to a angel. My angel was born stillborn Sept,2 2011 because a doctor sent me home with a broken water. The hospital I was seen at performed a ultrasound and a pelvic exam and diagnose me with low amniotic fluid and a infection. I was discharged the same day with no treatment. Two days later my daughter would die. Dezira autopsy report revealed she was a healthy baby and my broken water played a major part in her death along with problems with my placenta. All of this could have been seen on a ultrasound and treated. I could have been treated by giving my baby steroids for her lungs, antibiotics for the infection she developed from my broken water, and bed rest in a hospital.
The doctor who discharged me and my daughter with no treatment walks free with his medical license. I want justice for my daughter and victims of medical negligence resulting in stillbirth. Many women are denied justice when it comes to being victims of medical negligence resulting in stillbirth. I will never be able to rest and to be at peace knowing justice has not been served for my daughter. I believe my daughter was suppose to be born alive. A 23-24 week baby has a 50% chance of surviving if born premature. My daughter was never even given a chance at life to prove if she could survive or not. My daughter deserved a chance to take her first breath.
