What will the bill do?

  • The bill ensures the humane care and treatment of dogs and cats in the custody of large scale dog and cat breeders. 
  • Requires dog and cat breeders to obtain a license from the Texas Department of Licensing and Regulation (TDLR)
  • Requires TDLR to conduct an initial pre license inspection and routine inspections every 18 months thereafter;
  • Requires adequate wholesome food and clean water for dogs and cats;
  • Provides confined dogs and cats enough space to easily sit, stand, turn around and lie down in a normal manner;
  • Requires proper ventilation and adequate lighting for animals confined indoors;
  • Requires structurally sound shelter with proper protection from inclement weather conditions for animals confined outdoors;
  • Ensures adequate sanitation conditions within the living spaces; and
  • Requires proper handling, treatment and veterinary care.

 Across the United States puppy mills are on the rise.

Sites like Craigslist and nextdaypets, as well as web marketing by individual breeders, means that puppies increasingly are being shipped all over the country – and that unwary buyers usually have no idea of the conditions in which their new pets were bred and raised.

Texas is now one of the top puppy producing states where no regulation exists for businesses selling through the Internet, flea markets or classified ads.

Animal-welfare advocates are looking to the Legislature to help, saying Texas' size and lack of strong laws regulating breeders have allowed cruel operations to flourish. Read More

Require Commercial Breeders to Obtain a License for Selling through the Internet, Flea Markets, Ads

Dear Governor Perry

Please show your support of legislation that will require a commercial breeder in Texas to obtain a license, pay a fee set by the Department of Licensing and Regulation, and allow initial and annual inspections to uphold basic U.S. Department of Agriculture rules by signing HB 1451.

I understand that currently no regulation exists for businesses selling through the Internet, flea markets or classified ads. I would like to see new regulations in place requiring commercial breeders using these methods to obtain a license, pay a fee and held to annual inspections.
