Stop trying to evict Lola the Service Dog, and her owners!
The Issue
UPDATE 3/21/12:
We received legal papers today from Delkap Management's attorney that they are bringing us back to Housing Court and trying to evict us even though Lola was going to leave. We were advised that Delkap did not have any legal standing in demanding Lola to leave because the Human Rights case is not finished. She will not be leaving now. We did register her as a service dog and she's beginning training this weekend.
If Delkap is successful in housing court, they take possession of the Co-Op and we will not be able to sell it or receive any money from Delkap. Essentially they will be taking away our home and leaving us with nothing.
PLEASE send this petition to any and all contacts you have, it is important now even more than ever. There is so much on the line.
I am in desperate need of help to bring this situation in the eye of the public. My mother owns a co-op in Queens, NY that has a no pet policy which has been in affect for 20+ years, despite that there has been a dog living in the building for roughly 13 years. A year and a half ago my mom's cardiologist wrote her a prescription to have a dog around her 24/7 because it helped with her heart condition. She also suffers from rheumatoid arthritis.
The co-op refused the doctors note even though there is an FHA law stating they have to make reasonable accommodations for those with disabilities. They moved to evict my mom, myself and our shih tzu Lola and we went to eviction court over 6 times before the judge threw out the case. Had they won in eviction court they would have been able to take ownership of the home that has been in our family for over 41 years. We filed a complaint with Human Rights as soon as they refused and do not have a decision yet but Delkap Management sent us a letter that the dog has to be removed by March 23rd, 2012 or she will be forcibly removed and they will bring the case back to Housing Court to try to take our home away again. Even though the co-op was listed for sale on April 28th, 2011. The dog will eventually be removed when the home is sold. Why must Lola leave my mother's side?
I'm taking Lola and staying with friends in Florida until our home is sold, but that means my disabled mom has to live alone until that time comes. The co-op has been horrendous with their treatment of us since the dog came, we're even had to call the police. Yet there has already been a dog living here for 13 years and they did not take legal action then. If that's not discrimination I don't know what is. We need help fighting these people, and need to bring public awareness to the necessity for emotional support animals and therapy dogs.
WE NEED HELP BOMBARDING DELKAP MANAGEMENT WITH LETTERS OR PHONE CALLS TO TELL THEM WHAT THEY ARE DOING IS WRONG!! They are the management company for Lindenwood Village C (where the co-op is) and have been the ones sending threatening letters.

Section 504 of the Rehabilitation Act of 1973 ("Sec. 504") and the Federal Fair Housing Amendments Act of 1988 ("FHAA"), require that persons with disabilities have an equal right to housing as those without disabilities. It is illegal for a landlord to deny housing to a person with a disability because that person, or someone associated with that person, has a mental or physical disability. Under the statutes, disabled persons are also entitled to reasonable accommodations so that they can equally use and enjoy the dwelling.
