REPEAL THE NDAA - PASS S2175 / HR4192 THE DUE PROCESS AND MILITARY DETENTION AMENDMENTS ACT 2012

On Dec.31st 2011 Obama signed the National Defense Authorization Act into law. Clauses 1021 and 1022 of that bill legalize the indefinite imprisonment of any American citizen by the MILITARY without charges, evidence, trial or legal representation - all of which violates the 1st, 5th and 6th amendments to the constitution - on the accusation, not proof, that the person has committed a "belligerent act" or "substantially supported" a force hostile to the US. These terms have no legal meaning and can be used to justify the arrest and imprisonment of any person for anything. All but 10 senators voted "yea" while the House was split.

Senator Mark Udall (D_CO) and Congressman Adam Smith (D-WA) introduced a bill in March 2012 (S 2175/HR4192),  THE DUE PROCESS AND MILITARY DETENTION AMENDMENTS ACT OF 2012, which amends the NDAA to:

1) Repeal section 1022 altogether (the new bill nullifies the requirement of military custody of civilians) and
2) guarantees that any person detained within the United States shall ONLY be remanded to a civilian court and that all persons will be guaranteed all due process as guaranteed in the constitution.

(Read the bill here:

http://thomas.loc.gov/cgi-bin/query/z?c112:H.R.4192:

This bill officially nullifies sections 1021 and 1022 of the NDAA, the sections pertaining to indefinite detention by the military of American citizens and legal residents. ** THIS IS NOT THE SAME BILL AS SENATOR FEINSTEIN'S DUE PROCESS GUARANTEE ACT, A BILL THAT  AMENDS THE 2001 AUTHORIZATION TO USE MILITARY FORCE AND ONLY APPLIES TO FUTURE DECLARED WARS. THE BILL WE ARE WORKING FOR HERE, SENATOR UDALL'S BILL, SPECIFICALLY REPEALS THE UNCONSTITUTIONAL PROVISIONS OF THE NDAA.

Find your representatives and how they voted on the NDAA here: http://www.senate.gov/legislative/LIS/roll_call_lists/roll_call_vote_cfm.cfm?congress=112&session=1&vote=00230#position and here : http://www.govtrack.us/congress/votes/112-2011/h932

Congress also passed the "Trespass Act", a bill that would have made ML King's March on Washington an illegal act. In addition, Senator Lieberman is sponsoring the "Enemy Expatriation Act" a bill that would remove all citizenship rights of any person accused (not proven) of having committed a "belligerent act".

We, the undersigned, request immediate passage of S 2175 and HR4192, The Due Process and Military Detention Amendments Act 2012. We pledge not to vote for any member of Congress who does not support the repeal of sections 1021 and 1022 of the NDAA, the sections that relate to indefinite detention by the military of American citizens .

We need one million signatures to sway members of Congress.. . Please circulate it.

    3. HOUSE VOTES TO KEEP INDEFINITE DETENTION IN THE NDAA 2013

The Smith -Amash amendment to the NDAA, the amendment that repealed sections 1021 and 1022 of the 2012, NDAA and restored our right to a trial, was defeated in the House by a vote of 231 to 182. Check the article and find your representative and how he voted. Call him tomorrow and urge him to pass HR 4192, the bill that repeals indefinite detention by the military. Then call your senators and urge them to vote yes on S2175. Our victory in court last week, which found the NDAA provisions unconstitutional, may be short-lived, as the White House will move on Monday to overturn the injunction in an appeals court. I will keep you posted as this progresses. Article is here: http://www.informationclearinghouse.info/article31363.htm

chris Hedges and other journalists who sued the White House for unconstitutional measures won the case in a New York Federal Court. see link to Glen Greenwald's article. Now we need to call our reps in Congress and remind them that a Federal court has ruled the NDAA unconstitutional. They need to repeal sections 1021 and 1022. The White House will appeal this ruling, so we cannot declare victory yet. ie The Fight is NOT over. Keep up your work on this. http://www.salon.com/writer/glenn_greenwald/

Response to a question,: Since the National Defense Authorization Act is the annual bill to fund the military, there is no way that the entire bill could be repealed. Senator Udall's bill repeals section 1022 in its entirety. This is the clause that says "covered persons" detained within the United States shall be turned over to military custody. He "repeals" Section 1021 by stating that American citizens detained within the US must be remanded to a civilian court- either state or federal - rather than any of the other options listed in the original NDAA -IE military tribunal .Clauses 1021 and 1022 of the NDAA were first authored by Senator Lindsey Graham (R-SC) who does not believe in the right to legal counsel for "national security" defendants.
We have a long road ahead to get this bill passed. Call your reps and urge them to cosponsor this bill Then post this petition everywhere, scream it, because the media will never mention it. It is up to us pressure them. Thanks.

This movie will illustrate why our representatives are selling out the American People - they are now part of the problem whether they've been duped like the rest of us or have been bought out. Please watch this movie and respond accordingly if you want to preserve your freedoms. It's up to us now.
