Civil Liberties Monitoring Committee herewith presenting the facts relating to the case of life prisoner Mohammed Abdul Qadeer and expressing deep concern over his health condition and also condemning the attitude of Andhra Pradesh government towards a Muslim prisoner.

 

 

 

Since 1990 Adbul Qadeer is languishing in jail. During communal riots, Abdul Qadeer who was a police constable, at that time observed that his superior officer gave firing order on the innocent people. Unable to see the injustice of his superior officer, he took out his gun and fired at that officer. Due to which he expired. After that Abdul Qadeer surrendered himself before the police. After his surrender, police tortured him in inhuman manner. At that time communal hatred was on its peak. And the total hatred against Muslims was taken out on Abdul Qadeer. Later when he was produced in the court he was injured severely. He stated in the court of Law that it was an emotional act because he was unable to bear the killing of innocent people by a police officer whose duty is to protect the life of the people.

 

 

 

The Court gave him life imprisonment. Since then he is in jail. He was put in several jails such as Rajahmundry, Visakhapatnam, Warangal and now he is in Cherlapally jail. Even in jails he was discriminated badly. He was put in high security and egg-shaped cell. Even in jail he was continuously harassed and tortured. He was beaten by other inmates’ especially non-Muslim inmates. It is also known that a family member of the officer, whom Abdul Qadeer fired at, had beaten him mercilessly with iron rods due to which his hand and leg got badly injured. The same leg was not cured completely and he also became diabetic, the condition went worse and now its condition is that the doctors have advised him to mutilate that leg.    

 

 

 

He completed sentence in the year 2004. But still he is languishing in jail. His health has deteriorated to such an extent that he looks much older that his age. At present he is suffering with many diseases such as mental depression, heart disease, diabetes, Blood Pressure etc for which he was hospitalized many times. From the past four years he is not even released on parole in recent years, except on his mother death.

 

 

 

Ex-constable Mohammad Abdul Qadeer is the son of late Mohammad Abdul       Qader R/o misrigunj locality of old city Hyderabad. He is 55. He has 4 brothers and 5 sisters. Abdul Qadeer is the eldest. He got married in 1986 with sabira begum, just four years after his marriage the incidental accident occurred on December 12, 1990. At that time Abdul Qadeer was performing his duty at Shalibanda police station limits of old city of Hyderabad.
Abdul Qadeer has two sons and two daughters. The eldest daughter is 23 and has done B.Com. The elder son is doing polytechnic in civil engineering. Abdul Qadeer’s wife is no doubt an excellent mother and a faithful wife.
Abdul Qadeer is not being released on parole on the occasions of Ramadan and Eid-ul-Azha for the last 3 years. He was released for 7 days on June 3 of 2011 on the death of his mother.

 

 

 

Generally, any government releases the life prisoners on the basis of their good conduct. But in this case, even after the completion of 14 years, and presently he has completed 22 years in jail and his health has completely collapsed, he is still not released only because he is a Muslim. He had killed a police officer only to protect the life of innocents. Even though he has completed his term of life sentence, he is not released only because the governments are taking revenge. Thus, he is a political prisoner.

 

 

 

Therefore, Civil Liberties Monitoring Committee requests Honrable president of India to intervene in this matter as this is a very important case and the matter of life and death of Abdul Qadeer. At least in his last days of his life, he should be allowed to spend time with his family. He has suffered more than what he was ought to. Kindly take immediate action and instruct the AP government to release Abdul Qadeer immediately.

      I appreciate the idea and the campaign for Abdul Qadir and sympathies his conditions. Sending a fax or an email to the above said VIP's is useless because first most of the emails do not reach them (because email is full with its capacity. Secondly the emails are read by secretary or any other staff, who do not bother to readit and convey to the responsible persons, even we received message delivery but few days recieved the confirmation that the mail was deleted without being read.

      The law is above everyone. And it is the duty of officers to implement the law. But when the officers abuse the law and kill innocents, the common man has no option but to take matters in his own hands,

      There should be another fair investigation in to the matter and if the in charge officer did indeed kill innocents then Abdul qadeer must be applauded for and rewarded for taking such courage and being so brave,

      We should thank him for bringing an immediate end to injustice being committed before his eyes by a corrupt officer. And should encourage others to stand up to officers who violate the law.

      Lastly, he should be compensated by the government for each and every day he suffered in jail.
