Currently there are 17 states and Washington DC (over one third of the country) where voters have approved the use and possession of medical marijuana for residents that have qualifying medical conditions if their doctor feels that marijuana may help with their treatment.
The biggest problem that medical marijuana faces is that the federal government targets legal medical marijuana patients because marijuana is a Schedule 1 drug. This means that marijuana has no currently accepted medical use for treatment in the United States.
The federal government claims there is no medical use… however, patent #6,630,507 issued to "The United States of America as represented by the Department of Health and Human Services" states unequivocally that cannabinoids are useful in the prevention and treatment of a wide variety of diseases, including auto-immune disorders, stroke, trauma, Parkinson’s, Alzeheimer’s and HIV dementia. The patent, awarded in 2003, is based on research done by the National Institute of Health.
Patent #6,630,507 is a legal document in the public domain which contradicts the US Government’s stated position with regard to the classification of marijuana as a Schedule I substance having no “currently accepted medical use”.
So I ask you this President Obama, how is it possible that marijuana has no accepted medical use when the federal government owns the patent on marijuana for medical use? Patent #6,630,507 clearly states that “Cannabinoids have been found to have antioxidant properties, unrelated to NMDA receptor antagonism. This new found property makes cannabinoids useful in the treatment and prophylaxis of wide variety of oxidation associated diseases, such as ischemic, age-related, inflammatory and autoimmune diseases. The cannabinoids are found to have particular application as neuroprotectants, for example in limiting neurological damage following ischemic insults, such as stroke and trauma, or in the treatment of neurodegenerative diseases, such as Alzheimer's disease, Parkinson's disease and HIV dementia.”
It has become very apparent that medical marijuana is a necessary and legitimate medicine that helps many sick and dying Americans. It's estimated that America obtained its 1 millionth registered medical marijuana patient earlier this year (2012).
We the people of America deserve to have freedom of choice as far as our health is concerned. Medical marijuana has proven itself in its ability to treat and even cure medical conditions that pharmaceuticals simply can not.
According to an approved statement from the US Department of Justice in 1988, "Nearly all medicines have toxic, potentially lethal effects. But cannabis is not such a substance. There is no record in the extensive medical literature describing a proven, documented cannabis-induced fatality. In practical terms, cannabis cannot induce a lethal response as a result of drug-related toxicity."
It’s time for change President Obama. The people have spoken and medical evidence has been proven by countless studies including studies conducted by the federal government. Thousands of DEA licensed physicians value the medical benefits of medical marijuana and choose to use this remarkable medicine as a treatment for their patients even with the risk of losing their medical licenses.
It is a gross misuse of power to target these sick and dying Americans.
It is simply irresponsible to use our sparse federal resources to thwart the will of the people in the 17 states and Washington DC in which voters have made medical marijuana legal.
We the people demand that you immediately sign an executive order that will reschedule marijuana from schedule 1 (having no accepted medical use) to the correct designation of schedule 3.
