This petition is in opposition to the reinstatement of Mr. Kenneth 'Keg' Berlin and Mr. Joshua Cardine, to full membership rights and privileges in the United States Equestrian Federation ("USEF").

Federal Criminal Case Background

 

Excerpt from US Attorney General's Briefing

"Second, the prohibition on employment in the equestrian industry was
reasonably necessary to protect the public. Cardine engaged in a long term, extensive fraud scheme in the equestrian industry. In carrying out the scheme, Cardine stole horses from their owners and sold them without the owners’ knowledge. In other cases, in full breach of the horse owners’ trust, Cardine sold their horses at the request but reported the sales price as substantially lower than the actual sales price so that he could fraudulently keep more of the sales proceeds. Cardine also seriously
abused and mistreated horses, causing severe injury or death to the animals. Finally, Cardine endangered young children riders by selling horses he knew were not only not suitable but exceptionally dangerous to the young riders, falsely assuring the parents that the horses were sufficiently gentle for young riders. The children also
suffered psychological impact in the disillusionment resulting from learning their trainer was a thief. In addition, the district court had the benefit of the opinions of a large number of persons engaged in the industry concerning the appropriateness of Cardine’s continuing in the industry, who stated in strong terms that Cardine should be prohibited form horse-related employment. Thus, the record amply established that Cardine should not continue in the equestrian industry."

 

Background: On September 13, 2006 the Hearing Committee of the United States Equestrian Federation met and made the following resolutions.

"KENNETH 'KEG' BERLIN, of Newport News, VA, violated Chapter GR702.1a, GR702.1c, and GR702.1d of this Federation, in that on February 24, 2004 in the United States District Court, Eastern District of Virginia, in Criminal No. 3:03CR424, he entered a guilty plea to Count 1, conspiracy to commit fraud and swindle of livestock in interstate commerce, namely to: 1. Obtain and use the property (i.e. horse) of another which has a value of $10,000 or more..."

"For these violations of the rules, the Hearing Committee members present directed that KENNETH ‘KEG’ BERLIN be found not in good standing and that effective immediately and until further notice, be denied any rights to apply for membership to the Federation and that he be banned from any Federation Licensed competitions as a spectator, participant, or in any other capacity pursuant to Chapter 7, GR7-3,1b, and any horse or horses, completely or in part owned, leased, or of any partnership, corporation or stable of his, or shown in his name or for his reputation, whether such interest was held at the time of the alleged violation of acquired thereafter also be banned pursuant to Chapter 7,GR703,1c. The Hearing Committee also directed that is retains jurisdiction, and no sooner than 5 years from November 8, 2006 may Mr. Berlin apply to the Federation to be removed from the ban based upon affirmative proof of total rehabilitation, including proof that he has truly accepted responsibility for his actions and has taken steps to reform himself and has performed community service to benefit the welfare of horses.”

We, the undersigned, do not believe that Kenneth 'Keg' Berlin and Joshua Cardine have presented sufficient proof of total rehabilitation as required by the USEF prior to their reinstatement.

While we acknowledge that they may have taken some steps to be seen as adhereing to the terms of the suspension, we believe that they have demonstrated flagrant disregard for the spirit and intent of the suspension in the following ways:

- Have not apologized to their victims. Joshua Cardine wrote a "public apology" on a message board in February 2012, however in it he continues to minimize his crimes.

- Evidence that they lied under oath during the sentencing phase of their trial. While charges were never filed for perjury, a horse, the men denied having, was seized by the FBI in 2005. Grande Impression was shown by Berlin and Cardine in the International Hunter Futurity under forged papers, and later leased to a rider in Virginia. Grande Impression was recovered by victim Joan Watt, when she repurchased her from the ownership of the Federal Courts.

      It is simply unethical to support financial gain through abuse. It's also not at all about sport & this is one reason why I train, but have only shown once.

      Horsemen need to take a stand against the illegal actions that take place so frequently in the horse community.

      I delt with this man in the 1990's. He is a lier and a cheat. Tried to sell my horse without my knowladge. Watched him bred a boarders stallion without her permission several times.
