STEP UP TO THE PLATE WITH TRUE LEADERSHIP -- HALT INDISCRIMINATE 'BACKYARD BREEDING' OF DOGS!

      Stand Up for Dogs

Greatly reducing breeding by irresponsible backyard breeders ("BYB's") is critically important to reducing shelter INTAKE, unnecessary impoundment trauma, and killing ("euthanasia") of dogs throughout the U.S. and beyond. (For an excellent discussion of backyard breeding see: http://en.wikipedia.org/wiki/Backyard_breeder )

 

The national humane organizations petitioned here have the financial resources  (i.e. hundreds of millions of dollars taken in annually), staffing and stature to do this, especially if they will work efficiently via the National Animal Control Association (NACA), National Association of Counties (NACo), and National League of Cities (NLC) to demonstrate to municipal governments everywhere that this can be done cost-effectively, will reduce public safety and health problems, and will be far more humane than the situation that currently applies. They also can greatly lever these efforts if their grassroots advocacy staff will provide leadership support to animal volunteers simultaneously petitioning local officials (references to sample petitions are provided at the end of this petition).

 

To succeed, however, they must have the "will" and commitment to put animal welfare first....and the intestinal fortitude to proactively demonstrate to the mammoth $55.7 billion-per-year U.S. pet industry**, 'pro growth/pro-business' government officials, and staff of animal control agencies everywhere that initiatives to displace ubiquitous and unscrupulous backyard breeders with truly responsible breeders are worthwhile and not counter to the vested interests of these 'stakeholders'.   Most importantly, truly responsible breeders will not sell to obviously unprepared 'irresponsible pet owner' candidates but rather to those most likely to be "Pets for Life" owners.

The professional humane movement currently places far too little emphasis on reducing shelter intake.  While very important low-cost (and sometimes free...) spaying and neutering programs are supported to some degree... and while attention is given to the more visible and far fewer large commercial puppy mills, these humane organizations have long preferred to address the 'low hanging fruit'.  But what is best for companion animals isn't always the easiest route!

 

Our very small organization (which does not solicit donations) contends that 'backyard breeding' can be very cost-effectively addressed by complementing existing shelter-centric operations with a new community-centric emphasis (as would be carried out in the (red) Breeder-Buyer Interface Zone depicted in the graphic at the top of this petition). 

 

For strategies, processes and 'tools' to stop irresponsible backyard breeding, see: (1)  www.standupfordogs.com  (keep "drilling down" within the Backyard Breeding issue/"tab");  and (2) the blogs under the "Blogs" section (see Blogs tab) at this site.    Note how grass roots advocacy for the “POSTLEA” process (web reference (1) above) and implementation of the 'RED ZONE' described in the Feb. 10, 2014 blog: "THE KEY TO STOPPING IRRESPONSIBLE  BYB'ING OF DOGS" can increase dog licensure and readily be adapted to locating backyard breeders.  The May 7, 2014 blog: "A MORE EFFECTIVE DOG LICENSING AND BREEDER LICENSING METHODOLOGY, i.e. "POSTLEA" describes how this operates as a fast-acting "ratchet".  POSTLEA also can serve as a base for more universally justifying breeder regulation ordinances to municipal officials and enforcing such ordinances.  

 

The POSTLEA approach will increase dog licensure rates and revenues but, much more importantly, it is 'extensible' to cost-effectively locating and identifying "BYB's" and demonstrating to municipalities that truly meaningful breeder ordinances can be enacted, i.e. ordinances that are cost-effectively enforced and provide for objective standards of care by breeders.

      This extremely alarming article prompted Stand Up for Dogs’ following Aug. 31, 2014 communication to ASPCA’s Puppy Mill Campaign Coordinator with a “cc” to Matthew Bershadker, the current President and CEO of the ASPCA. Two web references (numbered “1.” and “2.”) follow directly below this email and serve to confirm that the past ASPCA president indeed is now employed by the Pet Industry Joint Advisory Council.

      The significance of web reference “3” below (taken directly from the ASPCA web site) is that Matthew Bershadker replaced Ed Sayres as ASPCA’s president on May 2, 2013. Not only then does the question of ASPCA’s level of sincere ongoing support for its (very sparsely staffed…) Puppy Mill Campaign program loom large, but the other burning question is why the current top management of the ASPCA hasn’t responded affirmatively to the “Step Up to the Plate with True Leadership…Halt Indiscriminate Backyard Breeding” petition that was initiated on Jan. 26, 2014…more than 7 months ago!

    11. UPDATE: General Boycott of ALL Breeders Becoming Even More Compelling

      Dear Supporters of one or more of Stand Up for Dogs’ 4 petitions (URL’s for these petitions are listed at the end of this update):

      We also want to acknowledge the continued support from many countries abroad and we’ve especially noted the recent strong support from people in Germany for the ‘Elevate the Legal Status of Companion Animals’ petition

      With these several petitions having been addressed to most, if not virtually all, the major player players in the U.S. “humane movement” – and with the passage of time – the idea of a nationwide boycott of ALL breeders is becoming ever more compelling (see especially the “3-Part Pledge Petition below). Use of such a boycott also may be of interest to our friends abroad.

      We wanted to answer, below, the questions asked by the sister of one of our co-founders which we suspect might be questions that you too may have. We hope you find the answers helpful. (Our next update will discuss political action committees (PAC’s) for animals and their important role).

      Her questions:

      “I like the boycott idea, as I said before, but does that mean to boycott to just keep them (breeders and others in pet industry) from interfering or to cause them to actively support by financial and verbal means?

      “Also, what is the ‘REVERSE ECONOMIC MULTIPLIER EFFECT’ ...?" I'm fuzzy on that, too.

      Answers:

      1. Both, i.e. to stop their legislative obstruction but, even more significantly, to cause them to PRO-ACTIVELY sponsor and support: a) legislation to elevate the legal status of animals; and b) legislation to stop irresponsible ‘backyard breeding’ everywhere.

      2. The 'Reverse economic multiplier effect' stems from the regular (i.e. not reversed) economic multiplier effect.

      Example of regular multiplier effect: You spend $800 around town. Those merchants, in turn, take the $800 you spent among them and they spend it for their mortgages, groceries, kid's shoes, etc. etc. Ultimately, your $800 'has been working' over-and-over again, changing hands among many...and stimulating the economy.

      The reverse of this produces a 'contraction' in the economy. If people adopt dogs from shelters...but otherwise don't buy (from ANY breeder) ...soon many breeders will stop breeding because it costs money (food, vet bills, etc.) to breed and breeding for some would become an exercise in futility if a significant number of people indefinitely 'deferred' purchasing dogs from breeders…UNTIL the pet industry ITSELF....under sufficient public pressure...pushed for legislation everywhere and UNTIL the buying public, in recognition of this, ultimately discontinued the boycott (This would need to be coordinated and done with adequate advance notice so that breeders could begin cutting back on litter production prior to implementation of the boycott(s)).

      As the total number of dogs then not being born would be geometrically or even exponentially reduced, the total number of dogs in our society would quickly begin to contract (a GOOD thing inasmuch as so many dogs are owned by extremely irresponsible pet owners ("IPO's).

      As soon as the total number of dogs starts to contract, this will immediately be felt by the entire $55.7 Billion/yr. 'DERIVATIVE' U.S. pet industry -- the "big box" pet stores, local retail stores, veterinarians, etc.

      This $55.7 Billion/year U.S. pet industry has reached this (2013) earnings level in uninterrupted fashion, year after year, and has reaped these gains even during the worst years of our recent recession. (If only the public at large had enjoyed such prosperity!)

      The pet industry lobby clearly can outspend animal advocates' lobbying efforts many times over. Even so, animal-oriented political action committees ("PAC's”) feel relatively successful when they get an anti-tethering bill passed....or a piece of legislation passed to replace gas chambers with alternative means of "euthanasia”.

      To their everlasting credit, the increasing numbers of PAC's in the U.S. are doing wonderful things for animals but it is very questionable whether they can succeed with such direct legislation ...i.e. more often than not and within a reasonably few years...on those much more fundamental issues (e.g. elevating the legal status of companion animals....stopping/stemming irresponsible l backyard breeders everywhere...) that the pet industry clearly does not want enacted.

      On such extremely important and fundamental issues, it is clear that legislators are responsive to breeder, veterinarian and other pet industry lobbies with "deep pockets". As politicians and legislators are so much more responsive to the pet industry lobby, let's then bring economic and ‘public image’ pressures to bear on this industry to sponsor and support the legislation that animal advocates may not be able to get enacted directly.

      It is our hope that the general public...and these PAC's....will view a general boycott of breeders ("Moral persuasion"...a return to 'Naderism"....whatever you choose to call it...) as indirect legislation to be used as a complementary tool along with direct legislation.

      Some (Necessary) Background:

      In an earlier update, SUFD notified the signers of all 4 of our petitions of the August 7 webcast to be conducted by “Maddie’s Fund”, i.e. "Everybody Wins: Learn How to Change the Way Animal Groups and Veterinarians Work Together”.

      Inasmuch as Maddie’s Fund (MF) is a very well-endowed national humane organization (a “family foundation”) whose stated mission is….”… to revolutionize the status and well-being of companion animals”, we were hopeful that this organization would respond to webcast participants urging support of this petition, especially as MF, for many years, has had a very close working association with – and influence on -- the veterinary profession.

      Although elevating the legal status of companion animals is SO VERY FUNDAMENTAL to: 1. derivative measures to substantially reduce indiscriminate backyard breeding and runaway shelter intake (thereby reducing animal deaths and animal rescues’ and shelters’ workloads); and 2. enactment and enforcement of much more stringent animal cruelty/abuse laws, this webcast, unfortunately, did not make these associations.

      Instead, most of the webcast was devoted to the economic plight of veterinarians, i.e. their smaller/’shrinking’ slice of the growing pet industry expenditure pie (this U.S. total pet industry ‘pie’ was $55.5 Billion in 2013), and the problematic public image of veterinarians!!

      AVMA: Stop Veterinary Opposition to Elevating the Legal Status of Companion Animals! Instead, Pro-Actively Sponsor Such Legislation at the State (All States) and Federal Level

      This petition has been initiated with the considerable concern that most of the general public in the U.S., including those who care deeply about dogs and cats (“companion animals’), have not been made aware of the ongoing opposition of the veterinary community to elevating the legal status of companion animals! (* Animal proponents in countries abroad might do well to see if this is happening there as well).

      The veterinary community opposition is, not surprisingly, monetarily based and claimed to stem from a fear of increased veterinary malpractice awards and malpractice insurance premiums. (This is addressed further near the end of this petition). Contrast this to what France has done, i.e.: “France altered its legal system by amending its 300 year old civil code to recognize companion animals as “protected property/living sentient beings”. [1]

      By opposing elevated legal status, veterinarians are ‘commoditizing’ companion animals and reinforcing the increasingly antiquated notion that they are mere ’personal property’ or ‘chattel’, i.e. no different than a suitcase, tire or chair! Many years have passed while numerous individual court case law decisions slowly have been incorporated into ages-old common law with increasing recognition that companion animals are much more than inanimate personal property. Unfortunately, the veterinary community has continued to oppose such changes. Contrast this opposition, for example, with an excerpt from a recent newspaper article: "During team training, students, such as Ben, are strategically matched with assistance dogs and learn how to work with them safely and effectively. The dogs receive training for two years and learn up to 40 commands before they are matched-up to become someone’s full-time helper." [2] (Ben is a 7- year old boy with mitochondrial myopathy).

      Opposing heightened legal status serves to oppose the heightened actual and perceived ‘value’ of companion animals at a time when ‘cheapening’ them can only be to their substantial detriment across the entire spectrum extending from poor care….through neglect and abuse…. to heinous and widespread dog fighting (pictured above) brought to the public’s attention in the ‘Michel Vick case’.

      Increasing companion animals’ legal status will pave the way for enacting and enforcing stricter animal abuse and cruelty laws. But even going beyond this abhorrent dog fighting, it is basic to causing pet owners to view them as having greater value and being more worth keeping… and to look for alternatives to dumping them onto overwhelmed animal shelters, both public and private, or outright abandonment. (Increased legal status and value would be entirely consistent with the ‘Pets for Life’ program of the Humane Society of the United States).

      (In Conclusion): Companion animals throughout the U.S. (and perhaps abroad) have suffered substantially from abuse and even extreme cruelty during the many years the veterinary community has opposed elevating their legal status and, thus, their value. You are urged, therefore, to not just ‘stand by’ while one-at-a-time case law decisions take many more years to finally correct this. Instead, move forward and proactively work with all states’ veterinary medical associations to sponsor states’ and federal legislation to recognize the true value of all companion animals…companion cats, therapy dogs, seeing-eye dogs, children’s pets, etc. As a possible legislative model, consider once again what France has done (discussed earlier above), i.e.: “France altered its legal system by amending its 300 year old civil code to recognize companion animals as “protected property/living sentient beings”.

    16. An Important Film that All Animal Supporters/Advocates Should See

      Dear Supporters of Stand Up for Dogs' (SUFD's) three petitions re Stopping Indiscriminate 'Backyard Breeding',

      The following information may be of interest not only to SUFD's supporters in the U.S., but to our growing numbers of supporters abroad ***.

      While SUFD's primary mission is directed 'upstream' of animal shelters and focused on greatly reducing shelter INTAKE (including major shelter reform, i.e. a 'Paradigm Shift', of the municipal animal control function everywhere), we'd be extremely remiss if we didn't bring the attention of our supporters to a a feature-length and 'extremely professional' film dealing largely with the 'No Kill' Movement, sheltering and adoptions

      (While it is stated that 'while a small number of images may be difficult, they are not gratuitous', please know that we at SUFD are highly sensitive and found the images to be relevant and quite tolerable).

      We hope the following information may be quite helpful to you and only ask that you please also continue to support the critically important objective of our petitions which strive to minimize the numbers of animals that must enter shelters in the first place.

      One of the issues that struck SUFD particularly favorably was the growing trend for shelters to be much more willing to release animals to rescue groups....required by law in at least one or two cited instances. By contrast, please also watch for the comments from those who suffered retaliation, i.e. were refused such release, when they were critical of shelter operations. In our view, transparency and constructive criticism should never be used a 'tool' against the animals and public uproar/outrage is needed wherever this occurs.

    17. VERY IMPORTANT UPDATE

      Dear Friends of Stand Up for Dogs (“SUFD”) July 14, 2014

      A very big THANKS to all of you who have signed and are helping spread this “Step Up to the Plate” petition – and, most hopefully, the other 2 petitions (please see below**) -- which collectively focus on fundamental and very far reaching solutions to excessive shelter intake and resultant carnage, both nationally and globally. These issues include irresponsible ‘backyard breeding’, elevating the ‘legal status’ of companion animals, and a ‘top-down’ approach to those many municipal animal control directors who allow their vested interests to rule their inaction in not working much more effectively to reduce shelter INTAKE.

      SUFD very badly also needs your further assistance and active involvement and creativity (this will NEVER be an appeal for financial help) to help overcome a tremendous and ironical ‘handicap’ here.

      We’re observing -- on other national/global animal welfare petitions -- abuse/cruelty issues involving a single animal….often restricted to a single community or animal control jurisdiction. When such issues are coupled with a rather sad or even shocking photo, a great deal of attention -- sometimes of tens of thousands of petition signers – is quickly drawn to the issue. And, this is not to say this level of concern or support for such issues is not warranted; it IS…and in spades!!!

      The unfortunate irony here, however, is that the very fundamental issues of backyard breeding, the consequences of companion animals being legally defined as mere personal property…and archaic animal control with its vested interests… are widespread with national and global implications. But, because it is easier for people to relate to one animal and one isolated situation – and because the much more far-reaching issues above necessarily require a little more time to read and digest – obtaining badly needed widespread public advocacy for actions benefiting thousands if not millions of companion animals is much more of a challenge!

      PLEASE….stretch your energies and creativity to their very limits in helping spread all three petitions to obtain maximum attention and signature support for these critically important issues.
