Lost Dog Coffee is a wonderful business with great coffee and art. It has been a cultural center for Shepherdstown for over fifteen years. With a website and Facebook page, Lost Dog Coffee has an online presence. Unfortunately a chain restaurant from Virginia, has sicced its lawyers to steal LostDogCoffee.com, even though it has its own appropriate domain, LostDogCafe.com.

Please support the right for a local business that has been recognized by magazines and locals and visitors as a treasure to keep its name and online presence.

    1. Dog Days of Summer! 1500 Sign the Petition

      Over 1,500 have signed the petition. And thanks to a legal digging, we are getting a fuller story of why Lost Dog Coffee should be left alone and how the chain misfired by waiting 14 years to even alleging an infringement. We are still waiting for the chain to realize its mistakes, the outrage of the public and retract the legal attacks.

      Some of us may be getting together, wearing our Lost Dog Coffee t-shirts, to deliver the petition in August. But whether you can join us or not, do help Garth out and look good wearing a Lost Dog Coffee t-shirt or hoodie. The other side is banking on Garth not having the resources to fight back--let's give Garth a fighting chance.

      As the potential for court or settlement looms, I hope that we can support Garth and the Lost Dog Campaign by getting more petitions signed, buying t-shirts and by seeing how the law is on our side. Also, there are links to many of the television and print stories over the last week.

    4. WJLA local news last night broadcast the story of the Lost Dogs!

      According to the story, other eateries are being targeted by the chain restaurant. We can not allow our fave coffee shop to be steamrolled by this attack. Let us stand up, continue to find more supporters and keep up the pressure on the chain. Already, the press and the comments from their own patrons is casting a glare on this bad behavior of waiting a decade or more to try and take the name of another business away.

    5. On the TV news again! WUSA shines a light on the legal attacks.

      Last night, WUSA/channel 9 broadcast a story about the fight against Lost Dog Coffee of Shepherdstown, WV. And over 1100 have signed the petition.

      We are still hoping that compassion and the outpouring of support for Lost Dog Coffee causes the chain to drop its legal attacks and demands that may hurt our local coffee shop. We will be bringing the petition to northern Virginia locations and reaching out to people there. If compassion and support are not enough, we will try reason as there is no need to attack or force Lost Dog Coffee into anything except to make lawyers' fees increase. Lost Dog Coffee existed before there were any registered trademarks, and was never noticed during the registration period or during the subsequent litigation between two of the cafes who literally divided the nation and ignoring the common law trademark that protects small biz from needless litigation. And if reason does not work, we are starting to crowd source legal help starting Saturday.

      Thanks for an amazing show of support from neighbors and from far away. We are still waiting and hoping that Lost Dog Coffee will be left to peacefully coexist as it has for sixteen years here in Shepherdstown.

      From California to our neck of the woods, people have been responding enthusiastically to helping protect our beloved coffee shop. Today there was another response according to the Washingtonian’s CapitolComment blog from the chain restaurant. According to the quote in the blog post, there is still the possibility that they will push forward with trying to take Lost Dog Coffee’s name outside a meeting of other demands that they have. Thanks to all your continued support, we are hopeful that the chain will end this all amicably without the need for lawyers and protracted costly negotiations that can drain the resources of a small business.

      We are still planning to bring the petition to their doorstep, Saturday, August 4th, so please pass on the petition site to your friends and neighbors.

      Not only have over 500 signed the petition, but hundreds of northern Virginians have heard about this issue as word has spread through neighborhood websites and email groups. And dozens have either signed the petition, left Facebook messages in support or passed word on to their neighbors.       I hope that the chain restaurant hears from even more of their current and potential customers who have joined our community’s cause to protect Lost Dog Coffee from the legal action--and retracts their legal threats.

      In under 24 hours, over a hundred signatures have been gathered! This will let the chain know that Lost Dog Coffee is not just alone to be picked on. Help get more to sign on. In addition, I am looking for those who can do the legal research to protect Lost Dog (more on the website http://www.lostdogcoffee.us/ ) and, better yet, find a pro bono lawyer who like great coffee ;-)

      Let us know if you want to bring the protest from the virtual world to the real world with a protest at one of their chain restaurants in Virginia (thinking Arlington). Perhaps Sat., Aug. 4th. Just an idea. Like it?
