Victory

Yesterday after almost 10 hours of testimony the county council of Hawaii failed to override the Mayor's VETO! Congratulations to our supporters and all who believe in the truth. You can see the Public Television show "Leilani Estates and Geothermal" Aired on Na Leo O'Hawaii Channel 54 today 8/2/2012 at 1:30PM and on the following dates: 8/3/12 10:00 AM 8/4 12:30 PM 8/5 11:30 AM 8/7 3:30 PM 8/9 9:00 AM NPR and HPR will be doing a story on our struggle to defend our community soon. Please look for our story on Hawaii News Now on KGMB and KHNL Channel 8 the same station covering the Olympics http://www.hawaiinewsnow.com/ There will be other public meetings with Geothermal experts in November '12 Please keep supporting this petition, I hope to keep it online so that others who find out after the mainstream media gets the story. NOW IS THE TIME TO SEND EMAILS TO SENATOR SOLOMON ASKING HER NOT TO HEAR HB 106-HD 2.

I am POSTING THIS NOTICE let you know that HB 106 HD 2 has crossed over from the House to the Senate. It will go to the Seanate Energy Committee first, then to Senator Solomon who chairs the Senate Water& Land Committee, then on to Ways & Means. P.U.N.A. has spoken with a staffer from the Senate Energy Committee who has informed us that Rudderman (who is Vice Chair of Senate Energy will pass it out because he supports buffer zones being imposed in Puna & elsewhere. The language now in HB 106 HD 2 was inserted by Environmentalists working with Rudderman on the House side. It was a "gut & replace tactic".
 
We can stop this Bill now be sending emails directly to Senator Solomon requesting that she not hear HB 106 HD 2. If this can be done, we will not have to go through a hearing process and risk gavin the buffer zones reinserted into the measure in WAM or at a Conference Committee. Senator Solomon has said that if she hears from the people of Puna she will listen to their concerns.

Here is a copy of the letter I just emailed to her:

 "Senator Solomon,

I am a resident of Leilani Estates, Puna.  I am requesting that you not hear HB 106 HD 2. If you refuse to hear HB 106 HD 2, we will not have to go through a hearing process and risk having unnecessary buffer zones reinserted into the measure in WAM or at a Conference Committee.

You have said Senator Solomon that "if you hear from the people of Puna" you will listen to our concerns.

My concern is that my property will be made worthless for no scientific or other public safety issue.  A health study is being conducted currently by Dr. Peter Adler and as yet no health threat has been identified.  What is the need for an arbitrary buffer zone?  HB 106-HD 2 is clearly a legal and fiscal nightmare, ill conceived and with no scientific or other proof to substantiate such a consideration at this time.

Before condemning property owners, let research be done to confirm or deny any need for such a buffer zone and why the state, or county should exercise such eminent domain with no scientific data or substantiated empirical evidence for such a radical and financially devastating law.

    2. County Initiates Independent Geothermal Health Assessment FactFinding Study

      This joint fact finding initiative will be conducted by a professional, third party neutral who will select and convene an independent Working Group to review existing data and come up with a final report. The report will be presented to the Windward Planning Commission to help inform its deliberations on the future use of Geothermal Asset Fund monies for public health related studies. The Working Group will be made up of 10-15 scientists, public health specialist and knowledgeable community members to be chosen by the consultant to represent all major points of view on the issue.

      The Working Group will be convened by Dr. Peter Adler of Accord 3.0. Dr. Adler is a nationally known and Hawaii based expert in the field of complex issue management and collaborative problem solving. He will be responsible for designing and implementing an independent fact finding process and for preparing an independent report due in February of 2013.

      We have successfully testified at the County Council of Hawaii to honor the Mayor's VETO of Bill 256, Draft 2. The bill would have allowed the County to create a one-mile buffer zone around the Puna Geothermal Power Plant without evidence.

      We must keep spreading the word, so that others that will find out about this issue can get involved.

      The Bill, sponsored by Coucil Chairman Dominic Yagong, was defeated thanks to you! You helped keep our community from being destroyed!

      Thank you for your support. Now we need you more than ever.

      The county council meeting to override the mayoral veto is scheduled for Wednesday, August 1, 2012 in Hilo at the council chambers. This is where you have the opportunity to share your testimony in person and via email.

      *You can submit written testimony by e-mail up to 24 hours prior to the meeting (it has to be received by Tuesday morning July 31st, 2012 - NO LATER THAN 12 NOON).

      Your email testimony can simply be "Support Mayor Kenoi's VETO of bill 256, draft 2" then sign your name, address, telephone & email address.

      **We need is to have as many people as possible come to the county council meeting in Hilo on August 1, to testify in person and to show our strength in numbers. The council needs to see, that we are not just a silent small group, but that there are many of us and we are willing to stand up for what is right.

      Thank you to Professor Don Thomas, Mr. Mike Kaleikini and Mr. Richard Ha for a great presentation and Q and A session. Na Leo O' Hawaii TV was there tonight as well as press from various publications.

      We had some tense moments but Aloha prevailed, and I hope we have more meetings like this but after the Mayor's veto is upheld by lack of county council support and our efforts to insist on a scientific evidence for any kind of legislation that would affect our friends and neighbors.

      Approximately 80 signatures were collected at the meeting tonight in support of the Mayor's VETO. Thank you to everyone, with all viewpoints, for attending.

      I live on the lower end of leilani estates, there is no reason for bill 256, no evidence of anything it claims, stop wasting money and time, live blessed press forward.

      The idea of the county purchasing all private land within the one mile radius is crazy! It would cost a fortune. And why buy up the land? Is there a health risk that doesn't already exist naturally on this island? There is not enough information for the council to commit to spending this exohorbitant amount of money.

      The families living near the plant have enjoyed a proximity to an active geothermal area for years. A plant does not change that fact. Let them stay - it is there property and it should be their choice when to move.
