Because people are in need of their money, we have been misled into believing that we would get "peace of mind" when we're left to fix the problem ourselves.

UPDATE: Form 8863 Processing, March 21

I wanted to personally give our clients an update on where we are with the processing of Form 8863 returns. The news is positive as H&R Block and the IRS continue our work to help get your refunds to you as quickly as possible.

Based on the data we are tracking, we know that in the next 48 hours nearly half of our affected clients will have their refund, or a date by when they will receive it. And the anecdotal information we are hearing from all of you – via our tax offices, client service agents, and your posts in social media – indicates this is ramping up quickly.

    2. UPDATE FROM H&R Block CEO

The IRS continues to aggressively work on processing these tax returns. Depending on several factors, the IRS hopes to complete processing the remaining 8863s by the end of the month.
We are also investigating some additional resources for our affected clients who are filing for financial aid through FAFSA. We want to reassure you that the processing delay of your return should not impact the progress of your FAFSA application.

As I said before, we know this has been very frustrating for all of you affected. The company continues to be focused on getting you your refund ASAP. Please be assured that your return was accurately prepared by your tax professional, who was able to find you the maximum refund you deserve.

We will continue to update you with any new information as it becomes available.

      Bill Cobb

Let me set the record straight about the Form 8863 issue that has affected you, our valued clients: we made a mistake when the tax return was sent to the IRS. And you deserve an apology, an explanation, and to know what we’re doing about it.

Here’s what happened: this year’s tax season started later than any in history (January 30th), followed by a further delay in form 8863 not being accepted until February 14.

Not good for everyone. When the IRS began accepting the form, we immediately sent your returns, with the intention of getting you your refund as quickly as possible. In our zeal to move so quickly, we missed a step. Specifically there was a disconnect in the transmission of form 8863 from our delivery system to the IRS E-file system, and this caused the delay many of you are experiencing. We fixed the transmission issue right away, but couldn’t undo it for those that had already been sent.

I want to make it clear that this was absolutely not the fault of your tax professional; your return was prepared accurately. This was an issue with the form transmission. This was our mistake — and I sincerely apologize. I want you to know that we hear the frustration of those impacted by this issue loud and clear, and we’re working every avenue we can to get your refund to you as fast as possible.

We have been and remain in daily communication with the IRS, who are doing everything they can to speedily process all returns. We know that clients are beginning to see progress, funding dates are being communicated and refunds are definitely being funded. But we also recognize that in an already delayed season, it’s still not as fast as we want, and we’re not letting up until every client has his or her refund.

We are also committing to more frequent and regular updates with you as we have news to share, and we know we can do a better job here too.

Finally, I know an apology won’t put your tax refund in your hands right away, and many of you still have questions. But right now, our singular focus is to get you that refund, and we have all hands on deck to help make this right.

This is from Scott (administrator of the H&R Block facebook page) who responded to a client concerning the refunding of prep fees. "When they (customer representatives from HRB) say it isn't their mistake, I think what they're trying to say is this glitch was not due to something the tax pro did. That is true. This was a transmission error and we at corporate own that. Still, they should provide our corporate number to you anytime you want it. It is 1-800-HRBLOCK". Thanks, Scott

      Valued Client:

We are writing to let you know that the IRS has confirmed an issue related to certain education tax credits claimed on Form 8863, which has affected and delayed your tax return. We sincerely regret this inconvenience and want to assure you that we are doing everything possible to work with the IRS and to resolve this issue quickly.

The IRS has informed us and other impacted providers that they are currently processing these returns and should be able to more accurately provide refund timelines via its “Where’s My Refund?” website. Please note this website is updated overnight by the IRS, so you don't need to check it more than once a day. It may take up to 4-6 weeks to process your return. However, some H&R Block clients are already reporting a change in their refund status since the IRS began processing these returns.

As a reminder, at this time, there is no additional action needed if you:

If you have received a letter from the IRS and have yet to respond, please call 800-HRBLOCK. The customer service agent will be able to better serve you and provide next steps.

If you applied for financial aid through the FAFSA program and you are waiting for your return to be processed, you can take the following steps to finalize your FAFSA application and proceed.

      The Department of Education suggests:

You can manually enter the tax return data on the FAFSA application if your return has not yet been processed by the IRS.
Return to the online FAFSA application to update the information when your return has been processed.

This information is posted on the FAFSA section of the Department of Education website.

As a block associate dealing with clients that are having IRS tell them to go to Block facebook to see that it says we made a mistake I think this needs clarification that the tax pro did not make a mistake on their return and we should not have to reissue a refund of tax prep fees.

i was one of the customers that didnt receive my taxes for 3 months from the date i had them done. I was kept in the dark for several months until i demanded someone tell me what was going on. I was not refunded for the fees i paid to have them done and i was also unable to get my financial aid due to the situation. i am now in debt because i was unable to catch up my bills and inquired paying out of pocket for my schooling. this whole thing has caused serious issues for me financially.

Just called H&R Block today after three months of calling and waiting to hear back from the escalation team only to be told that all complaints were closed as of April 30, 2013. Apparently the corporate office has decided that they will not be refunding anyone's money. I did not receive any correspondence indication this decision either. I resubmitted another complaint through the corporate office as well as one with the Better Business Bureau. My aunt and uncle in GA received a partial refund for this issue back in March. I'm just wondering why some are receiving refunds while others are being told no. It feels like some sort of discrimination to me. I got hit with a finance charge from a security deposit on an apartment that I should have had my refund to cover. Needless to say the finance charge was more than what I payed to have my taxes done which was around $160. Some sort of compensation has to be extended by H&R Block. How can a business get away with this???

H&R Block is blatantly ignoring the financial distress it put customers through in regards to this mistake. They should be obligated to pay back any fees charged.
