Appeal against the order of dismissal & eviction of Dr. Nilanjan Roy

Dr. Nilanjan Roy, my husband and renowned scientist at National Institute of Pharmaceutical Education and Research (NIPER) was dismissed from service last month. All because he exposed corruption and mismanagement at the institute. 

Charges against Dr. Nilanjan Roy based on which dismissal is ordered.

 I would like to state that based on the fictitious inquiry report conducted by prejudiced inquiry officer, current officiating director imposed penalty of dismissal from service vide order no F.1-16(8)/2011/Estt./343 Dated 20/04/2012 and withdrawal of facility by subsequent office order no F.1-16(8)/2011/Estt./323 Dated 20/04/2012 with immediate effect.

Punishment imposed by officiating director on Dr. Roy is rediculous to the charges fabricated. Dismissal generally ordered for gravest of the grave act like dowry death, rape or disproportionate asset worth crores of rupees. 

Perusal of the charged framed proved the fact undoubtedly. 

I & II Attempt to embezzle money by delayed submission of TA bill, During the framing of charges there no bill outstanding, bills were settled in 2009 and charges framed in 2011. None of the witness or documents presented in the inquiry proves that Dr. Roy had delayed adjustment of TA bill intentionally; it can be merely a technical irregularity.

III Non submission of answer scripts, NIPER director and senate chairman never communicated to Dr. Roy any direction regarding disposal of the same after his complain lodged in Aug 2009 till the framing of charges.

IV Deliberately not marking attendance, charges could not sustain.

V Suspension of the class, document presented in the inquiry and deposition of witness proves conclusively that manpower assistance was absolutely necessary for the course. Ex-Dean and F&AO deliberately prevented recruitment of manpower in the pretext of funds though sufficient funds (2.10 lakhs) were available.

      Dear Dr Katoch,
      I am Knowmics; writer of the blog “A Biped Against Corruption (both in .blogspot and .wordpress domains)” writing to you as the chairman of the Board of Governors at NIPER, Mohali. I came to know that an important meeting has been requisitioned by BOG members is scheduled on 21st July 2012 to discuss the corruption issues raised in these blog, published in the press Mail Today, Deccan Herald, Times Now, The Telegraph etc. and also became a business of parliament vide unstarrted question no: 1912 on 30-3-2012.
      I offer my witness under oath voluntarily to present documentary evidences, photos and recording collected through RTI and from other reliable sources to this high power statutory committee of NIPER. My intention is to prevail the truth, in front of the Board of Governors.

      Respondent Board of Governors, NIPER, through its Chairman, Indian Council of Medical Research, Ramalingaswami Bhavan, Ansari Nagar, New Delhi 110 029.

      That the petitioner is without salary for more than 3 months i.e. April, May and June, petitioner is facing immense financial stress and hardship to take care of his family and is left with no alternative but to seek relief from the Hon’ble Court as his dismissal is against the rules and thus arbitrary and illegal.

      I direct the Board of Governors to exercise such power as it is vested by the NIPER ACT shall take a decision on the appeal of the petitioner as expeditiously as possible and preferably within a period of 3 weeks from the date of receipt of copy of the order.

    3. Requisitioned meeting of NIPER BOG differed by Chairman

      Four members of BOG called a requisitioned meeting under the cluse 3.1.3 (b) of NIPER Statutes. The cluse says

      "The meetings of the Board shall be convened by the Chairman either on his own initiative or at therequest of the Director or on a requisition signed by not less thanthree members of the Board. A requisitioned meeting shalI be a special meeting to discuss only those items of agenda for which the requisition is made. The requisitioned meeting shall be convened by the Chairman on a date and time convenient to him within fifteen days of receipt ofrequisition for such a meeting."

      the meeting was fixed on 28th of May after repeated reminder of members now again it differed and fixed on 21st July. A ploy to protect the corrupt?

      Nilanjan is without salary for four months, the sin he committed by blowing whistle on corruption which is likely to be more then 100 crore. All 4,700 appeal is gone in vain.

      NIPER corruption is all time high and the Ministry of C&F transfered the responsibility to BOG. Though BOG had an impression that it's role is only advisory but the ministry made it clear that it is responsible for general governance and and mismanagement if any.

      To day me, my husband Nilanjaj my daughter Titir and son Aritra went to Convention center and talked to Dr, VM katoch at 2:45PM in front of all BOG members and NIPER faculty he is still non committal and not ready to take any action against KK Bhutani and Saranjit Singh's corruption and wrongful vengent action of KK Bhutani for dismissal.

      My husband asked him, "what is your advice to my kids? Do you want them to be honest or dishonest when they grown up?

      He went speechless for a moment and then said no no this matter is not related they can be honest. meaning guess it by your self. We could not.

      Sections of India’s scientific community are upset at what they allege is the victimisation of a whistleblower scientist at a premier academic institution who claims he has been punished for exposing administrative improprieties and financial irregularities.
      The National Institute of Pharmaceutical Education and Research (Niper) near Chandigarh dismissed Nilanjan Roy, associate professor of biotechnology, in April this year, claiming he had tried to embezzle funds, refused to correct students’ papers and stopped taking an assigned class.
      Roy claims the institute has concocted false allegations against him after he raised concerns about what he says were questionable appointments, irregularities in the purchase of diesel and spare parts of scientific equipment, and diversion of funds to unauthorised activities or projects.

      Silence oF NIPER Board of Governors on corrupt practices of Officiating Director surprises many, not only internal faculty but also external members of the scientific society. "BOG is extremely silent on formal complaints against corrupt Officiating Director, but quick to act on fictitious charges of Officiating Director against faculty members to victimized whistle blower/complainant" BoG is so silent that Dr. Neeraj Kumar had to get a court order directing Dr V M Katoch to respond.

Please call the chairman of the BOG, Dr. V.M. Katoch to include my case in the BOG meeting, constitute an independent investigate and reinstate my husband until all allegations are proved.

      The dismissal of a scientist on grounds of "financial embezzlement, forgery and academic misconduct" has sparked a controversy at the National Institute of Pharmaceutical Education and Research (NIPER) in Mohali near Chandigarh with the scientist denying all these charges.

      Nilanjan Roy, the scientist at the heart of the controversy.
      Nilanjan Roy an associate professor at NIPER was served a dismissal notice on April 20, 2012 and was ordered to vacate his official residence within a month. He says he has been punished for whistle blowing on the corruption and financial irregularities at the institute.

      However, the officiating director of NIPER Kamlesh Kumar Bhutani told Nature India that Roy has been dismissed "because of proven charges of financial embezzlement, forgery and gross academic misconduct" and that he was given "fair and full opportunity to defend himself."

      I have been collaborating with Prof. Nilanjan Roy for a number of years in the area of parasitic disease with the aim to discover an effective treatment. Together with other colleagues from Europe, we had applied to a call entitled “Tools to control trypanosomatides” in the FP7 and we are positioned among the top 10 worldwide. Recently we were successfully awarded the highly competitive New indigo grant (one of the 13 research project funded worldwide) with this research consortium. I find Professor Nilanjan Roy to be a very good trustworthy professional and I believe in the free circulation of ideas and positive and constructive actions as part of our mission as scientists.

      I sent the following to Dr Katoch on Monday, May 7, 2012. I haven’t received an acknowledgement.

      Dear Dr Katoch,

      I am writing to you as the chairman of the Board of Governors at NIPER, Mohali. As you are aware, Dr Nilanjan Roy, who has raised concerns about financial dealings at NIPER, was dismissed from the institute recently, by the officiating director.

      I know Dr Roy slightly but I do not want to judge the case. I believe that the case should be investigated impartially and thoroughly by an independent committee, and Dr Roy should be kept in his post pending such an investigation. As chairman, I urge you to take immediate steps in this direction, before further damage is caused to NIPER and to Indian science in general.

      My reasons for this are the following.

      There are very few in this country of above one billion, who could stood up to
      the truth. The corruption and malaise practices are nearly every where. Most
      of us think it is destiny, NO it is not. Hats off to you. Keep on fighting!
      But let your scientific work continues, that is very important, not for your
      self but for thousands of Indian scientists, who suffer from one or other kind
      of harassment at their work places. May it be promotions/Awards/positions or
      diversion of funds etc. The manipulators get the best, and those who act as

    15. Work Culture @NIPER

      I had associated with Nilanjan during my short tenure at NIPER as an Assistant Professor in the Department of Medicinal Chemistry. He seemed a nice guy and a dedicated scientist. I know the work culture at NIPER, it is really not conducive to do good research. Some senior faculties rule the NIPER and expect the junior faculties side with them whether their actions are right or wrong. If you are not one of them you are outcasted and face lot of trouble. I had very bad experience at NIPER which made me to come back to the USA. During that year (2007) alone three young faculties left the NIPER. I am saddened to hear the news that still the bad work culture continues and getting worst now. I request the BOG should take some action and improve the working environment at NIPER.

    16. Dismissal is not new at NIPER

      NIPER has previously dismissed a scientist, Dr Animesh Roy, who had alleged misconduct on the part of another senior NIPER scientist. Reportedly [1] an inquiry committee set up by NIPER's board found, back in 2009, that the allegations made by Dr Roy were true and he had been punished for whistle-blowing. Nevertheless, he was not re-appointed until 2011.

      I have started my career in science research in 1959 when I joined Biochemistry Department of IISc, Bangalore as research scholar in pursuit of PhD. Much water and science has flown during these 50 odd years and my impression is that the quality of science and science culture in the country has not improved even a bit. In fact I came across many more sincere scientists in 60,s than in later years. It is some of these scientists that are holding the fort of honest science even to day and in spite of being ignored by the powers that be.

      What I have been hearing about Niper for the last few years, only conforms to what I have said about Indian science in general and in worse. Many Institutions have been created and thousands of crores have been spent only to favour incompetent lot because of various factors which is a long list of Indian Diversity. People who have never done an experiment themselves are adorned with high Padma awards and such power to make or destroy careers .
