Stop Foreclosure Proceedings

My Father-in-law, Darrell "Pat" Hagans died Memorial Day weekend in 2010. Though my Mother-In-Law, Linda Hagans' name appears on the title documents to her home, her name was not on the mortgage held by Chase Bank, N.A. She did as Chase requested shortly after his death and then again late last year when she sent them copies of her deceased husband's death certificate and other documentation. In July of 2011 she suffered a stroke. In August she had the first of 2 major neck/spinal column surgeries unrelated to the stroke. She filed appropriate paperwork with Chase seeking a forbearance for three months on the loan while she was off work and receiving only disability pay that was not only greatly reduced from her usual pay but also reduced by the amount of her health insurance premiums. Chase never responded to acknowledge the paperwork to either approve or deny her claim.

Linda missed 3 months of payments. When she went back to work she immediately began to make her usual payments. She does this on faith because Chase has never provided any sort of payment coupon book to her or to her deceased spouse nor do they ever mail her any statements.

In May, Chase sent her notice of intent to foreclose due to failure to make the 3 payments. She called the number Chase provided immediately and was informed that because she was not the mortgage holder, they could not talk to her. She explained, again, that the mortgage holder was deceased and that she had submitted documentation to Chase twice. She was told, finally, at that time that she needed to get a power of attorney from a Court before Chase could address the mortgage with her. She did that and she submitted that documentation to Chase.

Two weeks ago, Chase again informed her of their intent to foreclose in 28 days and gave her a telephone number for legal assistance. Linda contacted the assistance number. She is getting the run-around as the people that she's told are handling her "case" are "out", "on vacation", etc. She recently found out that Chase has not even cashed her last two mortgage checks and now considers the loan to be more than 5 months in default.

Please help to stop Chase from foreclosing on Linda's home and make them acknowledge that she has done everything requested and provided all of the paperwork they've requested.
