No one should ever have to go through what baby Ava and her family is enduring. 

Stricter laws should be brought against those who drive while impaired everywhere in the United States. 

Those who drive impaired are at risk of hurting not only themselves but others, as what happened in baby Ava's case. This man was able to walk away from the accident he caused while high on PCP with cuts and scrapes, while Ava and her mother were not so lucky. 

It is disgusting that our judicial system will allow this man to walk away from this to only be caught again a short time later committing a similar act.

It is my hopes that we as a community and a nation can help keep people like, Andre James Kaczynski, in jail where they cannot be allowed to hurt anyone ever again.

Stricter laws need to be in place for those who have a blatant disregard for themselves and others around them.

I am asking for change. I am asking to feel safe again when I put my children in the car. Placing these MONSTERS in jail the first time will hopefully prevent any other family from going through the same thing.

      The Circuit Court criminal information includes several additional charges including a count alleging that Mr. Kaczynski caused life-threatening injuries to Ann Marie DelRicco by motor

      vehicle while impaired by a controlled dangerous substance. As a result of the Circuit Court criminal information being filed, the two District Court cases will be forwarded to the Circuit Court and will be consolidated for trial on a date to be set by the Circuit Court.

      State’s Attorney Beau Oglesby expresses great appreciation to the Ocean City Police Department and all those who diligently investigated this case. He also thanks the local community for their unwavering support of the DelRicco family. He adds that “the Circuit Court was clearly the more appropriate venue for this trial based on the seriousness of this case.”

      The case will be prosecuted by Mr. Oglesby as well as Deputy State’s Attorney Abigail Marsh.

      Counts 10 and 11 relate to a search and seizure warrant that was executed on December 22, 2011 at Mr. Kaczynski’s residence in Ocean Pines, Maryland that resulted in the seizure of Phencyclidine (PCP) and Marijuana.

      Mr. Kaczynski was originally charged for the December 16, 2011 incident in the District Court of Maryland and held on a $100,000 bond. Mr. Kaczynski posted that bond on December 19th, 2012.

      Mr. Kaczynski was also charged in the District Court of Maryland for the December 22, 2011 incident. Mr. Kaczynski appeared before a Worcester County District Court Commissioner who held Mr. Kaczynski without bond after hearing evidence presented by the Office of the State’s Attorney.

      Mr. Kaczynski was held without bond over the Christmas holiday, but was ultimately granted a $25,000 bond after being brought before a District Court Judge on December 27, 2011.

      SNOW HILL – On March 9, 2012, the Office of the State’s Attorney for Worcester County, Maryland filed a criminal information in the Circuit Court for Worcester County, Maryland charging Andre James Kaczynski, 47, of Ocean Pines, Maryland, with:

      1. Life-threatening Injury by Motor Vehicle While Impaired by a Controlled Dangerous Substance (Ava DelRicco);
      2. Life-threatening Injury by Motor Vehicle While Impaired by a Controlled Dangerous Substance (Ann Marie DelRicco);
      3. Possession of Phencyclidine (PCP);
      4. Driving While Impaired by a Controlled Dangerous Substance;
      5. Aggressive Driving;
      6. Reckless Driving;
      7. Negligent Driving;
      8. Failing to Control Speed to Avoid Collision;
      9. Speeding;
      10. Possession of Phencyclidine (PCP); and
      11. Possession of Marijuana.

      I, Kristen Heck, the petition finder, am not a family member of the DelRicco's. I am just a mother or two small boys who wanted to help the DelRicco Family any way I could. I am updated on Ava's condition via facebook post, so I am not able to give any more information then what is available to everyone. Thank you everyone for all your support!

      Ko Im reports: Del. Mike McDermott, on behalf of Worcester County's State Attorney's Office, has introduced "Ava's Law," a bill that would increase the penalty of a person who causes a life-threatening crash while impaired by CDS (drugs) from two years to three years in jail, with a proposed fine of a $5000 (instead of $3000). Baby Ava Del Ricco was critically injured in a December accident involving an impaired driver in Ocean City.

Through your thoughts, prayers and sacrifices our community has once again shown that the family values we hold so dear can lift the spirit and inspire thousands to selflessly give what is needed to those who need it most.
      The Office of the State’s Attorney continues to be committed to holding Andre Kaczynski absolutely accountable for his actions. While it may be true that Mr. Kaczynski was released from jail pending trial, that decision was made by the District Court of Maryland. This Office participated in his pretrial release hearing before a District Court Commissioner and convinced the Commissioner to hold him without bail over the Christmas holiday. After that holiday, our Office was again present when Mr. Kaczynski was brought before a District Court Judge and subsequently released on a $25,000 bond per

      My goal was to hit 10,000 but now I have decided I want as many signatures as we can. I want everyone to see that I and everyone else who signs this petition to see that we are not alone in this fight. DUI and DWI laws need to change now, if these people were treated the same as drug dealers and murders (which they can be) baby Ava would not be fighting for her life.

      Repeat offenders need to know they cannot do what ever they want when ever they want. You drive impaired, you go to jail.

      I have recently contacted several different legislators by mail this past weekend. I am hoping and praying that I will get some type of response from them within a few weeks. I plan on fighting this fight till something is done. If anyone wants to join in and mail letters to our legislators please do.       This is important to me b/c like Ava, I have a 3 year old and 8mo. old and I couldn't imagine this happening not just to me but to someone else but sadly it does so praying this will be a law soon!

      I believe stricter laws should be set in place for people that Drive or operate equipment under the influence of alcohol or drugs, especially when they endanger their own life as well as the lives of others. I have two boys ages 4 and 18 months. I sympathize with this family. Personally, I believe if capital punishment was reinstated nationwide we would have lower crime rates. I do understand that there are people that are unjustly accused; however, those are fewer and further between than those that have hard evidence and they still let them walk......

      I have a child with ASD and can see the improvement in his condition with therapy. ASD is treatable and is worth the upfront expense to reduce disability in the future.

      All children should have to opportunity to receive the quality of treatment needed to help them in any way live a "normal" life. Insurance premiums are not cheap , and it makes absolutely no sense why treatments that have been proven to work and help these children to develop and flourish not to be covered, and in return costing more in the form of special education funding for autistic children. There really should be "No Child Left Behind", so Ava's Law would be an insurance that every 1 of 88 children diagnosed with autisim in Georgia has the opportunity to early and the best treatment possible.
