Some sort of law needs to be passed that requires mortgage lenders to work with their clients to provide more ways to pay their mortgage. I recently went into default on my ELOC and had no idea because I had not received a letter of default. I knew I was late so I sent a payment to cover what I thought was the past due amount. Wachovia sent the check back because it was $38 short. That is when I found out that I was in default. The next form of communication I recieved from them was a certified letter from their lawyer claiming that they needed the balance of the loan $53,000.00 or our home was to be auctioned off in June.
I was in a state of shock to say the least. Then the next day we received a letter from Wachovia with a total of what was due to them within 5 days. Much better but still not in our reach. $2800. This figure included the past due amount plus $1400.00 in lawyer fees. When we tryed to negotiate with them to see if we could pay the past due amount the turned us down.
The only option they offered us was to a forebearance plan. Pay half now and half in 30 days. No problem if my husband hadn't been out of work for the past 3 months. We are in a state of extreme hardship and have a hard enough time keeping our water, electricity, and heat on.
Good news is my husband just got a job! Bad news is that Wachovia offers no other solution to our problem. I think that Wachovia should allow us to pay our past due amount and wrap the rest into multiple payments or put it in the back of the loan. Offer an option that is feasable for a struggling family. I got a small part time job after being a stay at home mom of twins and a 2 year old.
A law should be put in place that requires a certified letter be given to the home owner before the lender starts the foreclosure process and then there should be a 30 day grace period so that there is time allotted to pay the said amount. If no payment is received by that time then they should be able to go forward with the foreclosure process. I also think that the lenders should use the bailout money to help people like us to have more payment options. This would prevent many people from going into foreclosure. Foreclosures hurt everyone. There is no way we are going to let the bank take our home from us and are doing everything in our power to prevent this from happening. We just wish there were more options for us.
