As a special educator, I am outraged. If falling is a concern, then have staff walk with her while she uses it. Saying there's a fear of her falling is an unprofessional cop-out, and my guess is that it would be to cover for an unwillingness to provide staffing for ongoing supervision. Certainly, the school's physical therapist can write goals and work with her to increase her stability, and meanwhile, Mr. Director, just cough up the funding and set up ongoing supervision, and celebrate her mobility!
If you're afraid of lawsuits from falling injuries, then why let any kid walk around? Get every kid in your district wheelchairs so nobody trips, falls of playground equipment, or whatever.
