I read that many of the witnesses against Davis later recanted their testimony and stated that they felt they were coerced. Many of them stated that they didn't think Davis really committed the crime that he was accused of. If so much of the "evidence" against Davis is this questionable, it would likely be wrong to execute him, because then Georgia would put itself at risk of executing an innocent person.
Tom Drake performed a public service by revealing unconstitutional activity at the NSA, which often conducted warrantless surveillance against U.S. citizens that were often not even suspected of any crimes. Drake deserves to receive a medal, not prosecution.
